The example I had in mind was Games Workshop trying (& obviously failing) to trademark 'Space Marine'.

But in any event, there is an obscene amount of irony in that the company doing this is doesn't have licence or permission to reproduce the art that it uses on its merchandise. So as you say, fuck them, fuck this dumbass trademark and I hope this story gets enough traction among doujin circles to kick up a stink about it.

That said, there's a ton of SFW anime/manga appropriated art (of the more generally popular sort) merchandise flying around without licence or permission, so I'd like that to get addressed too.

That it's a word from another language doesn't matter. The biggest issue is that no court in the West will permit the copyrighting of words already accepted in everyday use, foreign or not. Specific, non-obvious combinations of words requiring a particular act of creativity may be copyrighted. And I'd be deeply surprised if China's court would permit this copyright, either. As a quick note, copyrights and patents generally pass if unchallenged. This means some flagrantly unreasonable ones will pass, but they'll collapse the minute someone prods them.

There's also trademarking: for instance, McD's can stop anyone using "I'm Lovin' It" to specifically sell a product, but they can't slap a cease on desist for anyone using it in other ways.

My father worked at the scientific end of intellectual property (i.e. amassing scientific evidence on whether patents really were novel, which would then be passed to the patent attorneys to argue in court). He said Japan used to have a nasty habit of rejecting patents from Western companies, and then okaying exactly the same thing a few months later from a Japanese company. This I suspect has greatly reduced over the years as major Western nations have increasingly harmonised a lot of their IP.

I think we need to be careful, because if IP collapses in a free-for-all, China has vastly more to steal from the West than the West has from China. It's thus probably better to hold our rules fairly and attempt to make China conform.
