They were trying to capitalize on the success of the Wii by keeping the name. They must have thought that the touch screen would be a selling point to the motion control crowd. They were wrong and I am sure many people on forums like this one were saying that since the first showing at E3 2011.
I think it was a controversial game and that was a fact, not an opinion. I don't think it's worth arguing about though.

The code in the download will be no different. What it really does is force people to trade in their physical games for digital ones if they want backward compatibility.
If it can read the disc, why make people use up their hard drive space and bandwidth? If it's anything like the Xbox and the 360, you won't be getting a large hard drive. I mean a 20GB HDD in 2005 was pathetic.
