One wonders why you'd shoot someone just for wanting a lift. And then not make sure you'd killed them, I guess.

Am I the only one who saw this and wondered why there weren't attempted murder, or at least attempted manslaughter charges if there is such a thing given he was under the influence? It seems to me that even if he wasn't trying to kill him, leaning out the window of your vehicle (was it moving?) and shooting someone stands a good chance of ending in that someone dying. Maybe he was actually trying to kill him and just missed? Surely they could tack on some other lovely charges for this asshat couldn't they?

The DA is probably going to go for a quick and clean trial on this one. Murder implies intent and manslaughter implies happenstance. Either way, a lawyer can snarl things up and waste time and money arguing the finer points. With DUI and felony assault, everything's clear cut. "Yep, he was drunk. Yep, he was armed. Yep, the gun went off and hit somebody. Ten years, parole in six with good behaviour. Next case please!"
