All Nintendo did was take down the link on the project's official download page. The game is still easily available through bittorrents, which the creators set up at the same time they officially released the game because they KNEW Nintendo would do this, they just didn't know how quickly. If anything, Nintendo drew more attention to the game. If you "Fail to defend your copyright", that "Failure" can be used as evidence against you in future copyright cases. Companies are forced to be insanely overzealous with their application of copyright.
