I think the guy with a missing pinky was actually at fault in a way mainly because his first reaction to a argument was violence, and trust me when I say that a good punch to the jaw makes you jam your teeth together, in pain and reaction.
So from what I see I think it was a accident on the biters regard, and that the puncher should be scrutinized a bit more then he was in the video, just for immediatly responding with violence.
Now if the bite was intentional that it's a different story, but if you jam a fist in someones mouth you're asking for something to go wrong
violence can be avoided if no one throws the first punch =P
