I'm with the other guy, they should have not let this leak and they should have kept it secret until it was done. Announcing something like this is just asking for it.

The problem is they can't possibly expect this to fly; Square Enix wasted Chrono Trigger: Resurrection, and this Star Fox remake is going to get equally stepped on. It's their IP and they'll protect it, even to the detriment of their own fanbase.

Now if they'd started the project under some other moniker and largely avoided attention by not duplicating ship designs, they could have released the game without scrutiny...

but oh look, all you have to do is type in "starfox" and poof, there's your Star Fox sequel. Not that that would have attracted any less legal ire, but then just getting the code out there is what's necessary. They could have pulled it in two days but once the code's in playable form somewhere uncontrolled, it's available everywhere. The publicity of an innocuous game getting killed because of a Star Fox easter egg would market it better than just calling it a Star Fox game straight out.

There are three possible endings

1. Nintendo pulls the dick move and stomps all over it, either right before it's completed or earlier
2. Nintendo slaps a N sticker on it and shoves it into the wii
3. Nintendo pulls the dick move but the dev team/ someone else leaks it to pirate websites

I'm hoping it'll be 3 or 2, if it's 2, they wont be pulling a dick move, and everyone wins. If they do pull a dick move, i hope it'll damage them without getting rid of the game. But because of the hype they'll be getting thanks to the gaming press, it'll most likely be the first ending.

Nintendo: What? They're making a Starfox game that isn't full of cute and suck? For free? How dare they?

I half hope that they do get shut down. Projects like this that piggyback on the popularity of other games often overshadow other projects that are more worthy of recognition. It's like, it doesn't matter how much good work you do, just use something recognisable from a million selling game and play their soundtrack on your youtube spoiler video. You will get much more attention.

Yeah, I'm a miserable killjoy.

They'll probably get their project cancelled. I mean "putting it on youtube doesn't help".

However, I don't know why companies shut down projects like these. A possible solution is to hire the underground team and make the game for them. Teams get their game and companies wins money. It's a win-win from this perspective.

Note* I have this feeling someone will kill my theory soon.

Just rename it StarWeasel - Shadows of Pyrat

Your wingmen are now Beppy Rabbit, Flippy Frog, and Falcon Lambada, and re-record the tune as a Wierd Al Style polka party remix...

Its now a parody and legally protected, right?

Push it a bit further by saying 'created by Dimtendo'

To me, it all depends whether it's a free fan update, or they're trying to make money off it, if they're in it for profit, then they're on dodgy ground using a nintendo brand to do it.

If its a fan homage, then damn, Nintendo need to realise the power of their fans, and instead of wasting money on lawyers, hire the guys to remind them what makes gaming fun.

50% chance its shut down immediately
50% chance it is shut down upon release
0% chance it is allowed to be played by the public

thats my breakdown

This sounds like it would be awesome to play, even if its based off an entirely different engine
But damn, Nintendo will be all over this faster than a car that goes really really fast...
So, if I can get my hands on it? Sure thing
But, that will be the hard part...

Hopefully, Nintendo just slap a giant N on the whole project and say 'sequel', and move on
The dev's of this have done really quite well, and deserve the money it could produce.
Yeah... or they might be bastards and do a SquareEnix - wait until about 1 week before the project is released, and then give a cease order.

Epic. But seriously Nintendo are going to stamp on it. I'l insert things in painful places if they don't. After playing it to death first of course

Solution: 1.Develop it silently without revealing your real identity or giving any leads that Nintendo attorneys could use.

2. Release it on a bittorrent site (make sure you upload the torrent and seed the torrent in an untraceable manner).

Whilsy it is just made by some very avid Star Fox fans, I must say that is impressive. If it does get released and they don't get attacked by Nintendo's Attorneys, it may be a good thing to look into. Seems very addictive.

Any fan make of an official title will likely end badly. I still remember when the 3d fan make of Chrono Trigger got shut down. Be best if the had released it for free before announcing it. Then when the boots come down, it will be spread across the net and near impossible to remove after the initial retraction.
