I'm trying to figure out why the tariffs are different in the first place. I like that the toy companies are trying to snag some loop holes. It's what they do. But really? how did the original tariff debate go down, that would be a transcript I'd like to see.

Of course the X-Men are human. How can homo-superior be their own species when all their mutations are different? If you're going to classify them as a new species, you'd need a new species for each one, not some dodgy blanket term for anyone who can do weird shit.

The thing with the tariffs is stupid anyway. Why should they be taxed differently? So if you have personified animals that can speak and have human personalities, you can flog your merchandise cheaper than if you had done the sincere thing and actually depicted them as human? That's retarded.

why do tarrifs like that exist in the first place, why the hell is one piece of plastic taxed differently? this is the most stupid thing i've heard this year and quite possibly last year aswell. man am i glad i am not an american, i would be pissed at this blatant waste of government resources.

But in the end, they are arguing about plastic lumps shaped differently from other plastic lumps. In the end, they are still plastic lumps.
Its like the guy who sued the people who sold him his RV when he got into an accident when going into the back to fix himself a sammich and left it on cruise control. Or the lady that sued McDonalds because she burnt her leg with hot coffee.
It is an exercise in silliness and stupidity that the world doesn't need.

Its kind of like how some people make such a big deal about killing children in video games. They are pixels that do not exist, so it doesn't matter.

oh, sure, this is only relavent for toys at the moment, but you know some dickwad is going to murder someone for being different and try and use that as an excuse.

arguing wether the x-men are humans or not is an important issue, but preserving video game history isn't... wow america... you disappoint me more every day...

Nice to see that the U.S. federal courts are handling cases that really matter...

We have high unemployment still, the gap between the rich and poor is getting bigger, but by God we had to make sure that mutant characters WHO AREN"T EVEN REAL are not human. That's what's really important.

Except that they are Plastic Lumps whose shape can mean the difference between paying $100 million to ship them in, or just $50 Million. That's not exactly a frivolous lawsuit. This is why the Court of International Trade exists; to handle disputes regarding the United States' international trade laws. If a company thinks that they're being unfairly taxed, the court gives them a chance to voice their opinion to the government. In this case, the government agreed, they were taxing them too much.

To settle whether fictional characters are human or not was not the reason the court heard this case. They heard it because a law was applied wrongly, and a company got screwed out of millions.
