We will never know really if it is truly illegal cause Goehotz didn't have the balls to take it all the way to court. He settled out of court and no legal determination was really ever made. Not a good idea to pick and choose when to obey traffic lights, but I'm just sayin' I don't think it's as bad as it sounds.
Terms of service/EULAs are already somewhat unstable legal ground because you have to agree to them AFTER you buy a given product (and if you opt out, then you lose the product you paid for), so it is hard to say if this is illegal or not.
