Wow, less Justin Bieber hate than normal. I guess his voice-plummet fixed things.

Anyways, I do question the girl's decision to go to a Justin Bieber concert unprepared. It seems more like self-harm than anything. A friend of mine asked if I wanted to take her to the JB concert the same day I read that the RUMOR that he MIGHT arrive in Sydney two days early resulted in nine girls taken to the hospital (eight with hyperventilation, one with A BROKEN KNEE). I turned her down, as I figured from that story that I'd be trampled to death and the last thing I ever heard would be a chorus that all of the harpies of legend combined couldn't match. If I HAD gone, and suffered hearing loss, I'd blame myself.

First off: The woman is not going to get 9 million dollars. She and her lawyer are high-balling the case in order to force an out-of-court settlement. Tinnitus is usually something that occurs over time, if I recall correctly, one of the band members of "The Who" actually has the condition from the prolonged exposure to his own concerts. Sometimes, loud explosions can cause permanent Tinnitus, like a bomb or artillery on the battlefield, but in order to win in court, the woman would have to prove that is was -specifically- this concert that caused her Tinnitus and not something else.

On the other hand, it has been a long standing legal fact that when you purchase something, you have every right to assume that using that product in a responsible manner will not harm you. Tobacco manufacturers have skirted this with heavy legal spending, and McDonald's won their cases against people claiming that their food caused obesity by claiming that the McDonald's corporation does not encourage people to eat their food every day. But, in this case, showing up at a concert can be assumed to be a "responsible use" of the purchased product, i.e. a ticket.

So, if she can prove that her Tinnitus stems from that concert, and she was not doing anything like putting her ear to the speaker, then she can win the case. Even so, it is unlikely the judge will allot the full 9 million, rather, payment for permanent medical services and a much smaller punitive sum.

She should have known better because she was going to a concert, a Justin Bieber concert at that too. Expecting to leave with your hearing undamaged is just plain silly when you're not wearing any ear-plugs.

Seriously, though, I wouldn't expect the case to make it very far. It's unfortunate that the woman is suffering this way, but it's a fairly predictable risk of attending a rock or pop concert; some people bring ear plugs to such occasions for just such a reason.

Just like that coffee thing, you're talking about the Liebeck, right? She put the coffee between her legs, opened it and then spilled it all over herself. Way I see it, it was completely and utterly her fault. Coffee might have been little hotter than usual but it was her fault for deciding to pour it on herself. I could see if she would've dropped the cup because of the heat but she was just clumsy. I would love to see someone trying to make a lawsuit like that in Finland. Judge would laugh it off.
Same thing with this woman. It's obvious how much screaming there would be at the Justin Bieber concert. She could've gotten ear plugs but she didn't. Not Bieber's fault. There's something really wrong about justice if lawsuits like these get through on regular basis.

Allowed herself to be taken to a Beiber concert without viciously punching the person who dared suggest it. Not too impressed by this women just on her own Merits.

Know what garbage is, and avoid it like it has the lurgy.

Just like when my dog thinks it's a great idea to roll around in a mud puddle I'm not too impressed by this lady's foresight.

Wrong. Her ear damage had very little to do with the speakers or Beiber's gondola.

Let me tell you a story - I was once unfortunate enough to stand amongst ~20 women when their heart throb (who will go unnamed) passed by and caused them all to scream in unison. I don't know if any of you have heard a girl scream at their maximum possible volume at close proximity. I mean rape-level volume (they can't possibly get louder than that...can they?). It's not just the volume, it's also the extremely high pitch. Multiply that by 20 and that's what my ears got. I was partially deaf for a full two days (constant ringing, couldn't sleep) before I finally started hearing normally again.

Now multiply that by 5,000 and you basically get a Beiber concert - the girls are there for Beiber, not his music. Add in the volume coming from the music itself and you're probably getting a constant 70-90db and spikes of 120-150db which, if you have sensitive ears and aren't wearing plugs, can hurt your eardrums potentially beyond repair.

Remember, a woman's scream is their greatest weapon and for a very good reason - it is loud as fuck and extremely shrill. History has shown more than enough proof of this. Maybe nature equipped them that way or something (damn you nature!).

FYI ear damage can happen in any concert...and while what Beiber did wasn't the smartest thing, this is NOT his fault. It's the woman's fault for attending the concert without knowing the consequences of being around his screaming fangirls. It must've made a heavy metal concert sound about as loud as a hair dryer.

Joke time!
A true Beiber fangirl would take the permanent ear damage as a BLESSING (from Beiber himself!), not as something to sue him over.

For comparison, 150 dB is louder than a jet engine at 100 feet. That may seem like a fair distance, until you actually are that close when it starts up.

It's also freakishly close to a shotgun blast, except longer and higher pitched. It's only ~30 dB from killing your hearing instantly, and 44 dB from being the loudest sound you can possibly hear.

That means that a screaming stadium full of women is about to a power saw what the loudest sound possible is to the screaming stadium full of women.

She knew the risks, if she didn't, she's really stupid, and I hate to say it, but she deserves it. Not like all the money in the world will stop the ringing, only time will do that. Greedy fucking American trying to grab money any way she can. These frivolous lawsuits are laughable, only in America would this be considered for more than the millisecond it takes to laugh at her. Even though I'm not at all a JB fan, I dislike these stupid people and their petty lawsuits more than all his music combined.

Note, I'm not one of those people who hates all boybands/tweenage dream people. I have nothing against one direction for instance, I just think their music's shit. I don't think they deserve any hate.

Actually that case was won for an entirely different reason. McDonalds had been making coffee so it would be too hot to drink right away to make sure people wouldn't get a refill right before they were leaving. Since this is not illegal the judges jumped on this opportunity to give them some punishment for a sleazy business tactic.

OT: It's a concert... I thought everyone knew about the dangers of loud sounds and how you have to take actions yourself in order to protect yourself from loss of hearing when you decide to go to one. I don't see this lawsuit going anywhere.

Also the tinnitus, or just the ring in your ears in plain English, goes away after a few days, a week at most and it's almost quiet again. Nothing to claim damages about. And that's from my experience of a pretty heavy blow to the head right on my ear that instantly made everything sound like it was underwater. Music should be less bad.
Tinnitus may very well be permanent.
I personally know a drummer with permanent tinnitus.

OT: If the tinnitus is permanent, I hope she gets some money, but 90 million is an unnecessary amount.
