Actually, it seems unlikely Sony could ever be awarded money for something like this, without first being able to prove this person has stolen from them to a defined value.
Couldnt they claim it is stopping sales of the playstation move by allowing a competing periferal onto the market for their console?

And also claim he has broken the EULA by playing with his playstation in ways that they didnt say were ok?
You are quite right, they could definitely make that claim, but the courts would have to determine an amount lost. I think Sony would first have to be able to prove that anyone besides this individual used the device on their system. He did break the EULA, but that won't mean a monetary award.

Except it has no packages installed.... it's runs through the PC and unto the PS3, without the use of any installed homebrew.

I am almost completely sure that while the Kinect didn't need a package install, to utilize the computer as an intermediary definitely did need a package install. There is no way he did this without the aid of homebrew in some way. The only instructions I was able to find required you to use a Teensy ++ USB microcontroller in order to do it. Meaning that you are inserting programming onto your PS3. It's not a package directly, but this is how the second generation homebrew came to be installed on your PS3 originally, still thanking Geohotz. =P

Knowing Sony, they'll remove the "USB" feature in an update.
And come out with an even thinner model claiming that they had to drop USB support to make room for the smaller redesign. Hrm, sounds oddly familiar for some reason.

not really...Playstations games are only going to be fully compatible with playstation move so people will have to develope drivers for EACH GAME that the ps3 comes out with. the kinect will only be used for user interface control and older games that the ps move isnt compatible with. the playstation move is obviusly better suited for shooters and more hardcore gamming. the kinect on a ps3 would be for shi** and giggles
