You are quite right, they could definitely make that claim, but the courts would have to determine an amount lost. I think Sony would first have to be able to prove that anyone besides this individual used the device on their system. I am almost completely sure that while the Kinect didn't need a package install, to utilize the computer as an intermediary definitely did need a package install. There is no way he did this without the aid of homebrew in some way. The only instructions I was able to find required you to use a Teensy ++ USB microcontroller in order to do it. Meaning that you are inserting programming onto your PS3.
