What's funny is that anyone that pirates console titles that ISN'T a total moron knows that most major upgrades firmware or otherwise are a no-no for the first week or so. Seriously, anyone on a modded console that was stupid enough to install this new firmware deserves to have their Xbox banned. You can almost bet that the VAST majority won't touch that upgrade til it gets a work around.

It's amazing how far just an inch of caution will take you in the world of modded consoles. "My friend" has had a modded console for well over a year, maybe two at this point, and has yet to have "his" console banned. Reason being, "he" doesn't play games prior to the release date, "he" doesn't even touch online multiplayer, and "he" avoids updates like this prior one like the bloody plague until they are suitably fixed. The only thing "he" ever did on XBL was Netflix but now "he" has a set top box for that.

EULA is not legally binding.
It really should be though. It would make things a lot easier and help the industry a lot.
No it shouldn't be. They can put anything into a EULA.

Console games are severely limited in every single aspect of the entertainment you get out of the game. Cant blame people for trying to make console games better using mods. PC ftw,lol

OT:Isnt piracy just for poor people anyway?

I've never been interested in modding my consoles, but it just seems like common sense not to update them like this. Hell, I didn't update my 360 recently because I don't play online anyway, so why should I subject my poor, innocent 360 to the festering Kinect-STD patch that will make the Avatars that I already hate even worse? And don't even get me started on that bloody mess of a layout that Microsoft has exacerbated. :S

The battle against piracy will never end, and the Pirates will always be winning. They throw stuff like this up, and it takes at most a month for it to be cracked.

People with hacked consoles don't play online because xbox live automatically fucks up their xbox when it detects the mods.
There are a very few exceptions, but for the most part, people with mods on their xboxes don't want to play online even if they could.
I'm guessing it'll take about 2-3 weeks for them to crack it.

Furthermore, a hacker could just use the illicit discs on a second console, WITHOUT linking to the internet, and therefore not connecting to xbox live, and therefore the problem would not exist. Theres alot of hackers, and their goals are simple. Countermeasures only last so long

Because you want to play multiplayer games online.

This has happened before. I know a guy who got caught back when Mw2 was released and a bunch of people got banned for it. The hardware gets ruined too. Which is a horrible thing because some people will go trade in their consoles and unless they get checked for online capability, some unfortunate sod could end up with it.
Like me... Bought my 360 at the time cheap just after the very first ban wave, and ya my xbox 360 came pre-banned from xbl

And also, with each update Microsoft release, there is a new EULA.

I mean, it's not that hard to understand and in certain cases it IS legally binding.

Okay, this may be dumb, and forgive me if it is.

I've only met one person with a modded console, and it was an Xbox, not the 360 but that old thing. Now the thing is he had all his games on a hard drive, thus no disc required to run. Now I don't really know anything about this but couldn't the pirates in question just do the same mod and be past this? Since ya know there's no disc check?

It's a bit more complicated than that, I'm not familiar with modding a 360, but I do have a friend with a modded 360. Be it a modded console or not, you can install games to the hard drive disk, BUT, in order to get them to run, you still need the disc itself, it loads some data and once the game starts loading itself, the disc stops spinning.

I don't know if this is a different case involving the Games On Demand program, where you can buy and download full games directly to your HDD, but I think it uses some sort of copy protection for it.

I don't think it's legal to vandalize or destroy someone else's property for any reason.
"Legal"ity loses all meaning when placed upon the sacrificial alter that is the internet.
ANYONE can take ANYTHING they want from ANYTHING if they know how.
I do not know any way to make that more explicitly obvious, than stating it as I have...

I just hope they've done their due dilligence in making sure the new scheme won't accidentally flag legitimate customers. Always a concern.
