It does seem quite pointless, since Pac Man has been out for 30 years now and it's free to play in various sites.

Unless he was charging for it, which I doubt...

I wonder if they'd go after someone who remade K.C. Munchkin or K.C.s Crazy Chase...

I wonder WHY? Can you even fucking BUY the original pac-man anymore?

Why can i just google "pac-man" and press "I'm feeling lucky" then bam, there it is, and they aren't served a notice to THAT game?

Hmmmm, do you think Google bought the rights to pacman when they had a version of the game on their homepage for its anniversary, or did namco just do it for the publicity of several million hits a day?

Its clearly all about the money, screw the independent and the young.

This is a prime example of why DMCA notices need to be expunged from the legal system, the student wasn't breaking any law, any judge with half a brain would of thrown it out, but the DMCA notices are so threatening that people almost always cave, even if they haven't done anything wrong, just so they can avoid the hassle, and companies know this, so they just shoot off DMCA notices at the least provocation.

Which is bullshit and at the risk of sounding like some stuck up wannabe freedom fighter, they deserve to have their shit stolen. That's just how I feel.
And how do you figure that?
Why should they not have the right to continue making money off of their product? I can say you deserve to have your shit stolen, it doesn't mean much without justification.
If you've already bought it on other consoles then (assuming you took care of it) you should still be able to play the original. If you never owned the original, now's your chance to buy it.
There are very few, if any, products in this world that depreciate in value until they are free. The only thing I can think of is perishable products, but by the time they're worthless to the company, they're worthless to the consumer as well (unless they're desperate enough to eat spoilt food).
It seems the pirate's justification for everything is that because it works with digital products a company doesn't deserve the same rights that every other industry has.

It is perfectly legal under fair use to use copyrighted materials as a student for educational use.

However you can't distribute it for non-educational use.
I'd have to check but I believe I recall that it is specifically protected by the DMCA as well.

Perfect example of just how fucked-up copyright law is.
No. This is a perfect example of how draconian some companies interpretations of copyright law is. It's like Tim Buckley threatening to sue a college student over using CAD in his flash animation class (which he did at one point). It's someone pretending that copyright law is permanently on it's side, when, in fact it's not.

I find it perfectly acceptable.

If a school/uni ASKED Namco whether they could use it, and they said not without a fee, I would call them heartless bastards.

Well, for all the legal reasons... They are in the right, it is there property but still... This is low. Attacking a bunch of students using it to learn... Why not pick on some one which a similar sized check book?.

At any rate, NAMCO coming out of the blue and deciding to go after a student for an IP they have showed next to no interest in protecting for... wow, it must be decades now, should pretty much be considered an abuse of the laws.
Not counting the Championship edition they released on XBL I think their last Pacman game was on the PS2... And it was a Mario Cart rip off (talk about irony). Now they have a game for the Wii that I don't know if it's been released or is being released called Pac-Man Party and that sounds like a rip off of the Mario Party games (Double irony... Heck all we need now is Call of Pac-man and we have an hat-trick).

But perhaps this is a good lesson for the student: if you're given tools to create your OWN game, don't just make someone elses.

he needs to learn to be creative and not lean on someone elses work to make his own
Just like anyone who ever tries to play guitar should start by composing a song, instead of playing Smoke on the Water.

One thing at a time. First you practice, and once you've learned, you put your skills to use.

I was going to suggest Michael Jackson and replace the ghosts with journalists and photographers. Make the power pills into lawyers that let him scare off the press for a little while.

*note rare use of good taste when ever fibre of my being wills me to make far less tasteful references*

Seriously tho, some companies need to understand what a 'right' is, it's not a rule that you need to enforce at every opportunity, it's something that you can invoke when needed. When something does not threaten either you or your 'rights' then it's probably best to just let it go and stop throwing money at your team of lawyers.
