a ballsy move, which i appreciate, but the law student in me wants to smack notch upside the head for suggesting such a thing ha so yeah im a little torn on this

No, I mean Bethesda. Look up their relationship with Interplay.

Here's the short story of it if you don't know.

1.Interplay is making a Fallout MMO.
2.Interplay is nearing bankruptcy.
3.Interplay sell the Fallout licence to Bethesda, the agreement is "We make Fallout MMO, you make Fallout games."
4.Bethesda makes Fallout 3.
5.Bethesda makes millions.
6.Bethesda goes full Kotick and sues Interplay to take away the rights for the MMO.
7.Court says no.
8.Bethesda know Interplay are standing on their last leg and is suing them again hoping to drain their resources in court battle.

This is how game developers should settle disputes. And I'm glad he wants to play an old game! They already have a strong case because no one can have a legal right to just one word without a context. Bethesda will lose in court. This way they actually stand a chance. If they decide to go with this, there has to be a live stream of the match!

This is also a good strategy to win over gamers everywhere. If Bethesda decides to go to court after this, gamers will hate them, and Mojang will get all the free publicity and love they deserve anyway.

But it's perfect! It won't cost the court anything, it'll raise publicity, it'll ease tensions between studios, and it might become the new norm for game devs!

I really doubt that they would. No-one refers to the elder scrolls games as 'scrolls.' This lawsuit is just kinda exploitative, they don't really think that people are going to mistake one game for the other.

I think Bethesda would do this. If they don't do it, bad image. If they do it, it looks good on them to settle it this way. Unless lawyers continue to be lawyers.

Considering it's ZeniMax Studio's (I think that's their legal department) and not Bethesda themselves, I doubt they'll actually accept this challenge.

Would be awesome if Todd did accept this just out of respect for Notch, at least he seemed to during their interview and dropped their legal department.

Cue the porn industry queuing up to sue the makers of this new 'Deu Sex' game. Honestly, unless this 'Scrolls' games is an open world RPG in the style of Oblivion, let it go, it's just making you guys look like dicks. I understand there was some conflict over Fallout, but really, this isn't the same.

If they succeed, I really do hope every publisher in existence sues Bethesda for using 'The' in 'The Elder Scrolls' when someone else used it first and 'Miss! misssss! HE'S COPYING MEEEE!'

but it also spits in the face of the legal process, if bethesda has raised this lawsuit, it causes problems for the courts who will suddenly get a letter saying "lawsuit dropped, we decided to settle things in the arena" its a legal issue, it should be settled within the legal system

Same thing i thought, it'd be like i made a game called "the elder" about an old man shooing kids off his property and getting sued for it.

It only seems reasonable to me that bethesda accepts since from simple reason i don't really see how they could win the lawsuit. But then again, when has reason outweighed money when it comes to lawsuits? :V

Great idea if every lawsuit would end like this we would have a lot more fun instead of fighting it in the courts we fight on virtual battlefields instead! I just say Go Notch GO!

notch is now the coolest perosn making games ever although i dont think he has thought this out all the way, Bethesda has a lot of empolyee's and i think some might be better quake players than notch but this is still funny as hell and i hope they take up the challenge

What part of that wouldn't be handled by the lawyers? Its not like Todd Howard sits on a +1 Chair of IP Villainy and starts shit with everyone.

why would they ever accept this, whatever they do they would lose

option 3. dont play -> tiney image dent, high change of getting name changed
i think notch would say they have to be employees, and nobody would hire a team just to play a game in this economy. bethesda has nothing to lose, really.
play and lose: they lose a massive lawsuit over a word.
play and win: they win a lawsuit they started without going to court.
dont play: they probably win the lawsuit in court, Scrolls gets a name change, not a single fuck is given.
