Rape is when someone has had sexual intercourse with someone while not under the right state of mind. Thats why its still rape if you have sex with a drunk chick and she calls the cops later, even if she said yes while drunk.

There's the issue of whether or not a person is actually capable of giving consent when s-/he is so smashed that s-/he can barely stand up or form a coherent sentence.

Have sex with someone without that person's consent and it's technically rape, regardless of how the "victim" feels about the encounter the next morning.

But the fact that the "rapist"'s judgement is skewed by drink is never taken into account?

I agree, if you're not drunk & they are then you need to be punished, but if you're drunkenly fooling around with someone & they change their mind the next day, that is not rape.

I suppose if they're both drunk to a level where they're judgment-impaired, and neither set out to get the other drunk for sex to begin with, then... they accidentally raped each other?

It gets weird when the law thinks you can't give consent while drunk, but you should still take responsibility for any crimes you might commit.

And not really. If the person is drunk, then you shouldnt be taking advantage of them while drunk, because you dont know if thats how tehy really feel.

As a family member of a rape victim (actually, fate has a really weird sexual interest in our family) I can safely say rape jokes can be hilarious. I just don't ever tell them around my family (except my brother, who also seems to be of the opinion rape jokes can be funny).
