It wasn't a technicality, the prosecutor saw that there wasn't enough evidence and wanted the victim to at least get a monetary victory in civil court. It's not like some clerical error got him off. Not that I don't think Cosby should almost certainly be in prison it seems (I don't know the ins and outs of the cases and claims against him), but if you send people to jail because we're pretty sure they did it, that's a pretty shitty precedent and completely against the values of our legal system. Our values is very much towards not putting innocent people in prison with the trade-off being some criminals get off because of lack of evidence vs putting just about all criminals in prison with the trade-off of many innocent people then being in prison. If you were on trial for something, you'd want to have your guilt proven vs "well... they probably did it", right?
