1. While he may suffer from many disabilities, there is no reason why he can't control himself and keep himself from acting like a dick online (We can only assume he was behaving inappropriately). He may have severe OCD, but I don't see how that lets him act like a dick (again, assuming that's why he was banned)
2. There are plenty of other social sites that are not PSN where you can communicate online without crowds.
3. First Amendment bullcrap argument again. You signed Sony's Terms of Service, they are a privately owned company, centered in Japan no less, therefore your American rights do not transfer online. Not to mention screaming profanities (again again, this is the easiest thing to assume) kind of abuses your 1st Amendment rights. Your rights end where mine begin.

While I sympathize with him slightly for his disabilities, that's obviously just a trick to gain sympathy from the Jury or Judge or whatever. Pointless lawsuit is pointless.
I agree completely. No reason for me to say anything, I guess.

Oh, wait! I have a witty quip!

Found this with a simple google search for the PSN ToS agreement, from Section 2: Code of Conduct:
When you participate in the PSN online community, you must act reasonably and with common sense...
Following this are 20 points describing what constitutes a breach of this code of conduct. The guy broke the ToS, lost his account and now wants money to make himself feel better. Any good court/judge/mediator/whoever presides in this type of case should throw this thing away before it gets too far gone. The guy needs to learn that just because you're handicapped doesn't give you an excuse to act like a dick, this isn't House...

But what is next? Asthmatics suing people who fart in their vicinity?
As an actual athsmatic I can guarantee that if I ever found out about this actually happening I would find it, then strike the plaintiff down for making people act wierd around me. Like seriously, scorched earth ************!

At any rate, how the fuck was Sony to know about this guy's issues? From their perspective, all they were doing was banning a user who had violated the rules and terms of use he had agreed to when he signed up, which they had good reason and were well within their rights to do. If he was making the game unenjoyable for other players with his behavior then he had it coming, that's how it is on WoW, XBL, whatever, he should have known better.

The person should of read the terms and conditions before launching this probable failure of a lawsuit. Like others have said he could join other websites and forums. Maybe he could join, oh I don't know? The Escapist! Dun dun dun

Jokes aside, I still want to know what he got banned for and what happens as this develops.

Hmmm, Agrophobia is a fear of crowds you say? LIke any phobia shoulsn't he be able to get over it somehow, locking him in a room with 50 people :D?
Doesn't sound like a disability regardless of the subject.
Or alternatively, it would break his mind. So you know, it wins either way.

But what if he got banned for something ridiculous like telling people he's also gay. You can get banned from XBL for that too.

If it's something like that situation, he deserves his thousands of dollars. If he was intentionally being a prick and hiding behind his disabilities, he deserves a swift kick in the ass.

Can anyone tell me what exactly he was banned for? What did he do, we can't exactly pass judgement without that info.
That's what we're supposed to be doing here right?
I see nothing ridiculous about identifying yourself as gay. Except if you meant that it's silly to do so in a room filled with faux-macho 13 year-old boys even I, a skinny shut-in, could most likely take out with a nice mallet and a head start. But I digress, as interesting as such a confrontation would be.

They don't have to let him use they're stuff. Especially if it's a website, no one ever guaranteed him access to it, and he agreed to the rules when he signed up.
And private corporations can restrict access to whoever they want, for whatever reason they want.

Personally, I hope get's thrown out. Not to sound insensitive (though don't also confuse that with me being in any way sympathetic to the guys woes) to whatever issues he has, but this just smacks to me as another example of compensation culture.

As has been stated here already, the guy shouldn't have acted inappropriately in the first place. It's his own loss and yes, there are plenty of other social outlets he could find online ot occupy himself with.

What if he did get banned for that reason? Does that excuse him from the rules if the rules clearly state that saying your sexual orientation could incur the wrath of the banhammer?

Wouldn't it be ironic if he was banned for running around telling everyone he is straight.

And she wasn't banned for telling anyone. She was banned for putting it in her profile. If she had just simply told everyone in every game she ever played she would still be playing.

I would suggest reading this before going off on XBL treatment of her

http://www.xbox.com/zh-SG/live/legal/codeofconduct.htm

It is laid out quite clearly in more than 1 point.

He acted like a dick. Being "sick" in not a excuse for ruining other peoples day by being a asshole.

I don't think that not being able to leave the house is just qualification for being a dick head. I'm Autistic, and you don't see me acting like a jerk, then using that as a crutch

Why do people keep assuming you can say whatever you want and call it free speech, especially on a privately owned network? Sure, here in the US at least, you pretty much say whatever you want, and not get punished by the goverment, but I think the owner(s) of the network has as much to say about the allowed content as a person does in their house.

I can see the kids point if he does have those medical illnesses but $55,000 is pushing it, just get yourself re-instated on PSN and don't exercise your "inappropriate behavior" any more.
Exactly.

Also, those disorders don't cause people to behave like pricks, so it's his own damn fault for getting himself banned.

This is also true. If it was a publicly owned network then fine, but Sony owns it so its Sonys rules.

I woulden't sue?
I dunno. If a person can get rich because they spilled hot coffee in thier lap and got burned why not take a shot? Although it would strictly be for monetary gain and would have nothing to do with the principle.

Did they stop teaching the Bill of Rights in schools now or are kids just to stupid to actually read what it says? The First Amendment is not a license to be a dick anywhere and everywhere.
Also, isn't Sony Japanese? I'm no law expert, but wouldn't Japanese or international law be what governs this case, not american?

As said by one of the robots in Futurama:
You ruthlessly applied the law with no regard to it's intent, bravo!
*paraphrasing*
Anyway, it's not gonna happen. Freedom of speech only works with government owned things.

What the hell? I can't see any reason for him to file a law suit. So what if he is Agoraphobic, how should they know that? He got banned because he broke the rules.
