He might be using the 1st Amendment, but breaking the rules (which he agreed to follow in signing up) is another. He's gonna lose.

Incidentally, I think the saddest bit is that he's so depressed and angry over a video game. Resistance, for that matter, whose sequel is one of the worst games I've ever played.

Go read a book or do something useful. Being banned from PSN is not being inflicted with 'pain and suffering', as you say.

1. While he may suffer from many disabilities, there is no reason why he can't control himself and keep himself from acting like a dick online (We can only assume he was behaving inappropriately). He may have severe OCD, but I don't see how that lets him act like a dick (again, assuming that's why he was banned)
2. There are plenty of other social sites that are not PSN where you can communicate online without crowds.
3. First Amendment bullcrap argument again. You signed Sony's Terms of Service, they are a privately owned company, centered in Japan no less, therefore your American rights do not transfer online. Not to mention screaming profanities (again again, this is the easiest thing to assume) kind of abuses your 1st Amendment rights. Your rights end where mine begin.

While I sympathize with him slightly for his disabilities, that's obviously just a trick to gain sympathy from the Jury or Judge or whatever. Pointless lawsuit is pointless.
All this except the sympathy. Get help for your problems or fuck off. Playing video games is not a suitable alternative to real human contact.
Unless you're agoraphobic. Then you may have issues getting out there for the human contact.

I'd like to see what got him banned.
Agreed, it must have been pretty bad to not only get him banned from resistance, but also the whole PSN.

Actually video games can be an effective tool to help some mental disorders.

For some reason I kept thinking it said arachnophobic, truly confusing, what the hell does spiders have to do with not being able to socialize? Or for that matter, PSN?

now i know this might sound harsh but he may need to bit the bullit (so to speak) why docen't he just make a new email address and psn account and get back to gaming, yes he loeses online data and achevments and he will need to re-add his frends and a few hours of gameplay but that its it half an hour if the worst comes to the worst but 55,000 is wayyyyy to much and damages???? like i just said it will cost his half an hour to an hour but probably the worst part is re-adding his freinds and saying he has been banned. if i was banned i would do it but i live in england and i was bulled as a child so im used to being given the shortest staw and putting up with but, but hay its my opinion and what i would do but i have free speach too.

ps. what did he say to get banned? cos im sure that in OTT poiticaly correct world of ours the other players may have been "offended" and im sure they have rights too

He'll fail. Yes he has the first amendment right. But he had to sign a contract that said if he is a ******* he will get banned in order to get on PSN in the first place. Specific rules override general rules.

By this kid's logic I can sue any real estate agent for not allowing me to post graffiti on their vacant buildings.

Wow, way to represent.
Apparently now my town's going to be known as a breeding place for mentally unstable nerdragers.

This reminds me of those old people who abuse the handicapped parking rights they got right after their hip surgery, but have since gotten better.
He's making a convenience out of his disabilities.

Whatever he did to elicit such moderator wrath probably made his ban well-deserved.
Just because he's "special," doesn't mean he should be treated any differently from the other countless ne'er-do-well's who populate the online community.

That said, I'd like to know exactly what the hell he did.

Firstly, I think fear of crowds is actually demophobia (at least that's what the Call of Cthulhu rpg book's section on phobias says).
Secondly, as pointed out by several others, you sign an agreement when sign up, so he's breached that if he's behaved wrong.
