The worst part is even if sony does go through the whole court thing their is no way they can coutersue for lawyer prices etc because the news and public would be all over them for taking a kid with diseases to court. This is loose loose for sony. I really hope this gets thrown out without any money to the guy.
the jury request is a pretty common lawyer trick, they do it so the jury can rule instead of the judge and possibly appeal to the whole group instead of just the judge himself.

however this won't go very far, as was stated the PSN is owned by Sony and run by them, so it's considered private. so free speech does not apply to in this instance.

as for them going for lawyers fees they could do that and just request documents be sealed and also request any settlements be kept secret, which is also another lawyer trick.

Well, no I guess your sexual preference is all just a state of mind. But I fail to see why one should be punished for disclosing that kind of information.

For the same reason this guy got banned. It was a violation of MS code and conduct.

And this is what she agreed to. Well there are other rules but they don't apply to that situation. It may seem like a silly reason to you. There are millions of people though. Some who feel homosexuality is offensive, a sin and lord knows what other reasons. It all comes back to where do your rights end and another's begin. It is begging for a fight just like it would be if I put in mine "practicing Satanist".

Ive played on both PSN and XBL and they each have their fair share of dicks. My guess is that you have to be an extra special gold star dick to warrant getting a permaban. If this is the case then I say he deserves what he got regardless of whatever disorders he may suffer from. Looks like he will have to go find another place to anonymously show his ass.

I just raged upon hearing this, if this kid is so mentally ill he should be put into an institution so trained staff can tend to his special needs otherwise he should stop pretending and stop milking the system for what its worth. Why can't people realize when you are on the internet you can't go around being a dick to everyone just because you are not talking to face to face.

Cases like these really dont paint a brilliant picture of America, specially on an outside view, being British and living in Britain my view on America is on outside view, dispite being there before and enjoying it and the people I spoke to were not too different from the people I speak to here cept a change in accent. I heard a case once, some one spilt hot coffee on him self, got burnt, sued and made a fortune, another case I heard was that a guy ran himself over with his car becuase he forgot to put his handbrake on, he sued the car company, along with watching the bull shit cases on judge Judy it kind of paints a truely disturbing image. It seems you'd fuck any one over to get a head in life, including family and best friends for minor things just for a couple of quid. I dont think this is the true case, ive met plenty of Americans and again no different from me or anyone else cept a change in accent, but like I said on the outside thats the picture it paints.

I also dont get any of the bill of rights, we did study them in my school along with alot of American history but I just never used to attend school (becuase I'm too cool for school, but cool enough to have to work at a garage cleaning down pumps becuase I got no qualifications for being so damb cool). These amendements it seems are the playing card for most Americans to get away with what ever they want from the looks of things lol. The first amendement is one I dont fully understand but to Americans like this kid suing listen, your little bill-o-rights only count in your country, you carnt walk into Britian carrying a rifle stating "I'm a American the bill of rights states I have the right to bare arms taking this gun off my is against my statatory rights(or how ever its spelt)" it doesnt work like that, Sony and psn along with most other forums and online communities dont go by the laws of any country and are not bound by any constitutions they set the rules, you dont get special treatment becuase your American and you have your bill of rights, nor does any person from any country get special treatment for anything they have.

an online community is like its own little country they set there own rules and they enforce them, you dont play by the rules and they will deport you and ban you from coming in to that country are theres not a thing you can do about it.

As for the kids illness, no excuse what so ever, I dont care if he was teriminally ill it doesnt give him him the right to getaway with being a dick online or plaguein online communities, My cusin as type 2 diabetese does that mean he can go into work and harass people no it doesnt, I'm cynophobic and acrophobic but that doesnt mean I have to be a dick with every one online, so disabillity is no excuse.

Funny really, I'm sure Sony would listen to a pleading letter sent by him.

He's solving the issue the best way, in that he is pushing Sony who will settle because there is a chance they will lose.

better soloution? well, don't be a douche on a game? if you know the rules? he did wrong, so he gets banned, it's called life. if he wants games that much, xbox hardly ever bans and he'll fit right in online. =]

In a weird way, I'm surprised SA hasn't triggered a suit like this before, with their (allegedly) ban happy mods.

As for those who're saying the suit is baseless, something to remember, if its genuinely frivolous the judge can toss the suit as soon as it appears in their courtroom, and most responsible attorneys wouldn't file a case that they believed would be dismissed summarily. So there's probably some genuine meat here somewhere, but I've no idea what. (It could be as little as one of the Resistance board's mods posting "STFU Retard" before banning him. (Though I kinda doubt its that clear cut.))

A, PSN is not the only non-outside/real life personal interaction

and B, there place, there rules. If some one went to a gay bar and started yelling out homophobic slurs then the owners of the bar would be well within there rights to kick them out.
