People are idiots when it comes to phones. Even if they are told they need to have them off they will not because whatever text they get from their BBF Jill is going to be so important and lifechanging that the rules don't apply.

when i get out of the Navy and get a job as a professor i am going to rule that if i hear or see your phone, you will automatically fail the next test.

the nursing classes at the college i went to had a similar rule: we see your phone, or hear it, don't bother coming back because you just failed the whole class.
I can understand that for the nursing classes. But this is just a developmental math class (that we aren't even allowed to use calculators for) I have learned my lesson about leaving my phone on for texting during the breaks at least

Germany has zero tolerance on cell phones, actually prohibited by law to prevent kids from 'watching inappropriate content on mobile devices' Same goes for mp3-players and tablet PCs ...
And, in all honesty ... as for the phones I agree with the idea of keeping them off ... No need whatsoever in school, unless it's some extraordinary stuff like relatives in hospital for instance ... And in those cases noone gives a flying ...

As for the topic ... Assumingly it's the US, so ... they can do pretty much anything, unless it involves actual violence, or is covered by any other clause denying it ... Check back with whoever deals with such things, and get that cleared.

Where I live it's rumoured that some teachers of the public schools will take the cellphone and drop it in the garbage bin if it goes off. I havent seen it, but its been said from a fair amount of sources that its happened. Where I am however, phones regularly go off and people show up around 10 for no good reason other than having been out drinking the night before. (But then again, most of us are physically bigger than our teachers :) )

If they can't kick you out for it then they should be able to. Phones should be off in class time end of. I've lost count of the amount of times I have been interrupted from concentrating in a lecture because of some fools phone going off.

The only exception to this is if you really need to be contactable at all times for a proper reason. In that situation then you go to the teacher/lecture and explain why it needs to be on beforehand.

Kicking you out of class seems the lesser of 2 punishments in my book. The college I went to, they didn't give a damn if you showed up or not. They got paid anyway. I'm sure they may reserve the right to boot you if you're being obnoxious about it, but marking your score down on the test?
Pretty sure that's fraud. Unless your teacher includes something like "participation points" alongside each test... Maybe just me but last I checked college professors didn't care enough to be up your ass like High School teachers did.

It's a college. They can probably kick you out for whatever they want.

I'm more weirded out that they took attendance. Maybe the first few classes to see if people aren't showing and there are open slots for people who want to add the class, but as a regular part of class?

Best school phone policy I've encountered was "If we see or hear a phone, we have to confiscate it to ensure you weren't using it to cheat. We'll give it to administration, and they'll check it when they have time - don't hold your breath." I don't think I heard a single phone in that class.

In my high school last week some girl got suspended for 2 days for texting in class.

To all the people saying things along the lines of "how hard is it to turn your phone off, just grow up, it's not that important to text people back etc".
First, the OP stated that he was turning his phone off, not replying or anything like that. Second, I have about 15-20 hours of classes a week. Am I an idiot because sometimes I forget to turn my phone to silent, or turn it off before I get to class?

OT: You being reprimanded for turning your phone off is just retarded. My lecturers mostly ignore phones. If a phone goes off, they pause for a few seconds, allow the person to stop it and turn it off, then they continue. Because they don't expect everyone to remember to turn their phone off every time. Considering you weren't even disturbing the class, I'd say your lecturer is just a *****.

Now, taking points off your test, surely that's not allowed... I don't know, you really should ask someone about that. Kicking you out, I don't think she can put up much of a fuss if you don't leave. I'm pretty sure I can't be forced to leave a class, unless I'm doing something to interrupt the class like constantly talking or something stupid. Marking you absent? Blatant lie, so you should definitely contest that. I just realised, I'm not sure what you mean by college though... Are you using it as a synonym for University, or are you in one of the countries where they are separate things? Cause I guess that could change matters.

Here in High School, they not only can mark you absent but also take your phone away.
I don't see the problem really, i don't even carry my phone to school.

From the title I was thinking that you were on about school, in which case it is made known that phones are against the rules and you can and will be sent out of lessons for having it out.

Then I noticed that you were on about college, which if it's anything like the college I'm at they don't need you there. You pay to go there and they have rules about phones (Usually made known).

Most of my teachers confiscate phones for the lesson (Which are 3 hours long) one of them does the same but also gives push-ups (He's allowed since he works for the army on weekends and also teaches our discipline in the public service lessons which includes Drill sessions)

I've been kicked out of lessons for talking, not talking, doing work (For a different lesson as I finished everything for the lesson I was in), not doing work and even for just looking high...

So yeah, perfectly viable for you to be kicked out of the lesson for having your phone out.

She can kick you out for that lesson (even if its stupidly excessive), can't mark you as absent.

If these tests have any bearing on the official grade you receive then that has to be against some rule, as your phone has no bearing on your academic performance.

That has to be against some rule; you should only be marked as absent if you did not turn up for the class on time.

I am just curious, are teachers actually allowed to do that? To subtract points from tests and kick students out and mark it against their attendance? I have the class tomorrow, I am not sure if she is gonna do anything else when I get there.
I'd suggest you talk to someone higher up at your college about the rules relating to teacher conduct. There's no guarantee she broke any of them but that does seem pretty damn draconian. If she did break any rules then chase it up, make sure it doesn't happen again.

Your teacher sounds like an ass, you'd really expect a teacher to treat you like an adult at your academic level, not a child. All of my teachers ban mobiles, but if you were to be caught with one and instantly turned it off an put it in your bag, they'd usually be okay with it, they certainly wouldn't be dumb enough to send you out.

in college...

this dude in math class fell asleep and the professor had him marked absent
needless to say I've been staving off sleep in that class as much as possible
(tho I think the teacher was having a bad day)

put your phone on silent or vibrate. don't look at your phone for 1.5-3 hours. stop complaining. remember you're there to learn and that'll probably learn you good for next time. anyone who bases their marks on attendance isn't a very good teacher. If you don't want to be treated like a child, keep your cellphone out of hand. I'm not saying she's right, it just seems obvious she has issues with cellphone use in class. I would too.

Of course they are. Well, it might depend on what the syllabus says, but in general, yes. If you got caught looking at a cell 5 times total in one of my classes, you lost all participation points, that's 20% of the final grade.

Another one of my profs would fail you on the entire class if your phone went off once during a students presentation.

How is it so hard to understand: don't use your cell in class? It's fucking irritating to everyone around you who's actually trying to pass the class, and it's disrespectful to the professor. Turn them off before you ever get in the classroom, or at least turn them on completely silent, not vibrate, cuz you can hear a vibrating cell-phone from across a lecture hall. Turn. It. Off. Life will go on if you can't text for 50 minutes. I've never died from it, even when I turn my phone off for my 1PM lab and can't turn it back on until I leave work after 10PM.
