Just check the feedback for the seller. That will give you a good idea of what their reputation is like.

I have never really had an issue with ebay.. The people that do I find are quite dodgy in life in general.
Venturing a guess, but I would assume because protests don't do jack shit. Especially against developers based in Japan, the US, and throughout the EU. I didn't think they had to protest against the developers.
