As for the punishment, we do have more than prison and death, there are restraining orders, fines, community service, restriction of rights (to own a camera for example), and there could be a couple more, I'm not researching crime and punishment. He deserves some punishment, enough to remain a deterrent from others doing this without permission, but it shouldn't equate to that of murder or rape. What kind of message are we putting out in a free society when people are too afraid to film their child's plays?
And finally, as for obeying the law simply because it says so, we come to an impart. I will not abide a law I don't have ethical faith in or belief in it's necessity such as that it would impact my or others rights negatively for amoral gain of a third party (like Sony suing Lik Sang).
