If they got the patent for it, they got every right to sue the living shit out of them.
I mean, 5.000$ isn't small fry. And for that much dough, I'd expect people to get the full fucking right. Not for some big corporation to use special ways to bypass the patent.
This I find insulting. I hope Nintendo will get a hard blow from this. It's only fair.

/sigh

I really wish there was more power in companies to remove patents off people who are mealy doing it to sue people.
Its getting stupid now. The whole process of patenting needs to be looked over.

Nintendo doesn't bring lawyers to lawsuit cases. They bring Link, Samus, and Pikachu; if you don't drop your BS claims, those three are getting let of their leashes.

....Samus with a lea- never mind....
She's already wearing a latex suit, a leash isn't going to take it much further.

Anyway, I do think these guys might have a leg to stand on. If Nintendo's WiiFit works on the same principles as the exercise-device, then they have every right to sue them, especially since they had already contacted Nintendo for this a few years ago.
Time will tell.

As much as I think those Wii Fit games are pointless, I hate patent trolling even more.
By the way, I patent the letters A, E, I, O, and U. Any unauthorized use will result in a lawsuit. Escapist Magazine, for your 6 infractions in your title alone my lawyer will be contacting you.
You may mock, but there's already been the smiley trademark - unsuccesful. [http://www.escapistmagazine.com/forums/read/7.80039-Russian-Business-Man-Trademarks-Smileys-Updated]

"Computer interactive isometric exercise system and method for operatively interconnecting the exercise system to a computer system for use as a peripheral" and "Force measurement system for an isometric exercise device".

Why not throw out there "computational system that draws operating power from an electrical current"?

I can't wait to see what lawsuits come out for the Vitality Sensor. Sure it has to be a win first, but they made standing on a scale a success.

Want to back that statement up with some facts?

I thought not, being as it's simply a false negative stereotype.
Alright ... in comparison to the rest of the world

Also - search "lawsuit" and all examples that arise are american based - high profile yes, but something can't block the Sun unless there's enough of it.

And its well known americans have lawyers handing cards at hospitals for example. I can't be bothered to find the website, but there is a publication of lawsuits filed worldwide and America is far and away the leader (I'm sure 2009 lawsuit figures or something would suffice).

Don't even try and get on your high horse when its well known that American culture is festered with lawsuits.
Buddy, I asked for you to back up your statement, not to spout further needles stereotypes. You failed to do that because the figures you offhandedly dismiss as so easy to find your not even going to bother don't exist.

Different countries have different laws and handle civil disputes in different ways. In the US it is true that corporations tend to handle disputes with lawsuits, but they are hardly ever frivolous, mostly the are seeking recompense for damages to their name, or for other reason, that the law does not expressly cover. That is just how our system works. There is nothing wrong with that.

The stereotype you are clinging to is the whinny self important out for a quick buck slip and sue guy. That doesn't exist. Those tales are all urban legends. As is your "well known" example that nobody has ever actually seen of the ambulance chasing lawyer.

When I ask you to back up your claims a bit you just instead tell me I am on a high horse? Just because something is widely believed does not mean it is true. Facts man that's all I asked for.

I added my "I thought not, being as it's simply a negative stereotype" comment early, only because I knew already that you either wouldn't find, or wouldn't look for, the information needed to even partialy back up your claim. Looks like I wasn't wrong.

They aren't really violating copyright until they release said product. Plus, there wouldn't be much point in suing over an unsuccessful product, not that Nintendo knows how to make those kind.
In response to the boldface text, two words, virtual boy.

As for the lawsuit, it is amazing that some company is trying to pull this, some people just have a need for pointless lawsuits.
Yes it did suck, but I bet Nintendo still put up a profit that year off of their other products. That's just how they roll.
