Haha.
Dumb-ass shouldn't have imported pedo comics.
Also, looking through the comments in this topic,
Stop defending him!
I'm all for freedom of speech, information, ect, ect, But seriously?
This guy imported CHILD PORN! He went out of his way to import pictures of CHILDREN HAVING SEX!
Why wouldn't I defend him? He is being sent to PRISON when I see no evidence of a CRIME.
If you can explain, clearly for my sake, precisely what he did is a crime and WHY I'd be thankful. As I already pointed out, child pornography is generally illegal because it is considered harmful to the children depicted therein. Obscenity is only a crime if the population at large is asked to endure it. He kept his collection private and the sex acts were being depicted by hand drawn characters. Unless we are suddenly going to protect the rights of non-existant beings and protest punish a theoritical future breach of the law there I see no grounds for this conviction.
Don't forget that there is generally no way to pinpoint the age of characters in drawings.
Most anime protests that its characters are all over 18
.
Technically if the gal on the first page of this thread is pedo then I know at least one Japanese Foreign Exchange student that was at my highschool that is pedo bait at 18 years of age
(She looks unusually young for her age even now).
Guess she can never get a date with any American if she was so inclined. Otherwise her date would be hauled off to jail as a pedophile.
By the way Uncle-ellis under the laws of the united states what Mr. Handley ordered is
not child porn because there are no actual children. This is why he was charged under obscenity laws.
The bottom line is that this case was never fought. The way the article reads to me is that the defendant took a Jury trial. The Prosecutor showed off the more offensive stuff in the guy's collection to offend the Jury, and the Defense Attorney felt that the way the wind was blowing that it would be better to plea bargain. Wanting to establish precedent, and knowing there was no real LEGAL case, the prosecutor gave him what was a major, sweetheart deal.
It's impossible to say much about the actual material, or most details on the case, because very little seems to have actually been done.
I've gone into my thoughts before, so instead of going into this whole thing again, I will simply say that I think this case is wrong largely because the guy bought from a legitimate merchant. Imports are looked at closely, which is why not all websites and stores are able to sell all over the world due to laws and such. If this guy just up and ordered this stuff then apparently the material had not specifically been declared obscene. This makes the case very similar to someone arresting you for buying something from any other store.
When it comes to pedophillia, I have mixed opinions on the subject. If your basically dealing with what amounts to teen on teen sex, that's no big thing. While contreversial, as I've said before I'm a proponent of improved sex ed in high school, and the distribution of free birth control. That's part of growing up. Some teen sex romp comic or game is nothing but a more graphic version of "Porky's" or "American Pie". Even if they bring out sex toys and such it's really not a big deal.
When it comes to fantasy, involving superbeings, demons, aliens, and other things it's so far detached from reality that I don't see an issue. Laws exist to deal with reality. In my opinion if you've got a character who can hold the weight of the universe on their shoulders then as far as I'm concerned they can be sexually treated like an adult. A good example of this would be say "Buffy The Vampire Slayer" which showed on TV. Buffy was like 15 or 16 when she had sex with Angel (who was physically like 30 and actually centuries old), nobody batted an eye for the reasons I'm pointing out. What? Is someone going to kick my door down now because I own every season of the show on DVD?
Horror can be a touchy subject, but again in such cases the idea of having a child raped, or molested by demons or whatever is supposed to be shocking and horrorific. If it gets a "WTF, that is evil and wrong" reaction, then it's doing it's job. That's what horror is all about. It's rated "R" or "M" specifically because it caters to a specific audience that is out to be shocked and can seperate the fantasy from reality.
I will also go so far as to say again, that I generally feel that it's okay to be attracted to teens. I mean heck, the term "Jailbait" exists for a reason. Rolling Stone had a giant "she's legal" announcement for Brittney Spears for a reason. I think people who deny this impulse are just fooling themselves, and creating problems. The thing is though that just because it's there does not make it right, this is why laws exist. We are not animals and can control ourselves. If you have an adult chasing around teen jail bait, he/she can do a lot of damage which is why it's illegal and should remain so for good reason IRL. The problem with a teen-chaser is a self control issue, and a dangerous one that needs to be dealt with.
Now people who chase PRESEXUAL humans are something else entirely, and deranged predators that need to be dealt with harshly. Outside of horror and attempts to shock I don't really see much excuse for sexual activity from like 9 year olds who don't even understand the concept and aren't even physically developed that way.
Basically, the only thing I'd really go after when it comes to comics is like adult / pre-teen sex without any kind of fantasy backdrop at all. Something like "Aqualung: the comic series" would be pretty much propaganda for monsters.
