Leland Yee Hopes To Keep Up The Fight


In spite of the Supreme Court's overwhelming rejection of a California law that would criminalize the sale of mature videogames to children, Senator Leland Yee wants to try again.

You've probably heard by now that the Supreme Court of the United States, by a vote of 7-2, has affirmed the right of videogames [http://www.escapistmagazine.com/news/view/111300-Supreme-Court-Rules-in-Favor-of-Videogames] to the same First Amendment protections as movies, music and books. It was a big win for the videogame industry and gamers around the world, not to mention supporters of free speech in general, and a serious blow to those who want to see games categorized in the same way as cigarettes and pornography. Yet despite the decisive ruling, Yee isn't ready to give up just yet.

During a press conference following the announcement of the decision, the senator said he hopes to come up with a new, narrower law that won't fall afoul of the First Amendment. "We're poring through the opinions to see where we can create a pathway for a successful bill that could withstand a challenge," he said. "The evidence is absolutely crystal clear that there are harmful effects on our children."

"Even with the existing court, there may be, if we craft the bill differently, there may be a basis for trying to get another hearing within the Supreme Court on this critical matter," he added.

Is Yee really that committed to his cause or is he just putting on a show of bravado in the face of defeat? It's been six years and millions of dollars wasted since he first proposed this legislation and I can't imagine that anyone, aside from possibly a few die-hards, would have the stomach for another piece of that action. On the other hand, you can never overestimate the dedication of a true believer. Yee may find it harder now to advance his anti-game agenda, but that doesn't mean he won't give it his best shot.

I'm not surprised that the fight is going to continue. Nobody these days will let sleeping dogs lie.

It's more a publicity stunt if anything, this guy just wants to move up the ladder and needs a poster child for his accomplishments.

This

I mean that is exactly what he is saying, he doesn't care about rights, he just want popularity and/or recognition for his next campaing; then again tell me how many citizens know their rights.

Either that or "I'm a arrogant fat-headed prick who just loves to waste the American taxpayer's money on hopeless causes."

Man am I glad I don't live in California, or in the USA at all, for that matter.

Yep, the dude is a believer. nothing I nor anyone else can say will get him to stop. Its ssad really but some people are just like that: Extremely closed minded.

Also Crystal Clear Proof my ass! 90% of that crap is completely one sided, biased, and leaves out WAY too many factors for them to be actual studies.

Even if he narrowed it there are still 5 people on that court that would tell him to piss off. And last I checked 5 out of nine is still the majority.

Hey Americans, answer me this - Why do you hold your Constitution in such high regard if every politician and their dog wants to change its meaning or circumvent it? Surely it must get annoying?

It looks like this guy is going to have to find the tiniest nits in the world to pick if he wants to get this case back into the Supreme Court

Bull. Shit. No such evidence really exists. The most you have are really poor studies that are contradicted by other really poor studies and you in the middle trying to get the government to raise children instead of their parents.

Hopefully this clown won't get reelected and then taxpayer dollars can stop being wasted on his nonsense.

Well, maybe he'll cause enough of a fuss and get booted out like Jack Thompson did?

And I would love to see this 'crystal-clear evidence' he's going on about. Last I checked, the only definitive evidence was that violent games only have lasting effects on people who are severely mentally disturbed.

I've been playing violent games since I was 6 years old, because my parents spent a lot of time with me and felt confident that I could tell the difference between fiction and reality. Kids still can't buy M-rated games without parental consent. If parents do their Goddamn duty as parents then this becomes a complete non-issue.

It's all political now. He made promises to get the money to fund all this, and he came up short. He can't go to them and say "We screwed up, game over." That's like a big company failing after one bad product- the investors won't let them get off that easy. This guy's fate is sealed, which is why all you hear are buzzwords like "crystal clear evidence:" they give the guys handing out the cash happy. He's in for a serious world of pain and suffering, but this is the path he chose to go down and now he must face the consequences, even in the midst of defeat.

Because it is what is allowing us to not have outrageous censorship which is what the politicians are trying to do with circumventing it. It does get quite annoying considering how the people have to pay the fees of them losing through our taxes. I really want someone to pull something to the Supreme Court and have them say that you cannot try and get this censored any longer.

The biggest bullshit is that we tout freedom to do what we want then we go and support bullshit like making it so that the parents are told what to do rather than let them decide whether or not their kids are allowed to do it by their rules.
