User comments under videos? Who the hell has actually got them mixed up? Hopefully they aren?t going to be using the comments from all the people who were JOKING.
I hope Mojang wins tho not out of loyalty to them. I haven?t played their games but they are in the right here and Bethesda are being dicks. I don't know anyone who even refers to The Elder Scrolls series as just Scrolls.

Call me an idiot, but does anyone actually CALL Skyrim the Elder Scrolls 5 beside gaming magazines/websites/press releases? Everyone I've met just says 'Skyrim'.
Y'know, I know several people who don't even know that Morrowind, Oblivion or Skyrim is called Elder Scrolls. No one calls it that.

no one calls the games the elder scrolls insert number here, they call them what ever the name is after the series title, like oblivion, or skyrim, or morrowind. the point being is that no one would actually get it mixed up, and bethesda knows this. they just want a quick buck, and they don't give a damn about their reputation. i hate this case, but let's face it, i'm still going to get skyrim, and if a new fallout comes out i'll be getting that too, and most people are probably just like this. so really, they have nothing to lose except respect, and if you haven't noticed, a lot of companies don't give a crap about if consumers respect them or not. as long as they make money, they don't care.

According to Kaplan, Bethesda's lawyers plan to use user comments about Scrolls videos, articles about the game and even screen shots to prove that gamers are likely to confuse Scrolls with the Elder Scrolls franchise.
Rofl, so essentially Bethesda plan to present a load of quotes of various people being sarcastic and proving how hysterical this case is? That should be interesting court case to watch....

"As you can see here, Trololo87 says, 'So @notch, is Scrolls an expansion of Oblivion lol'. Clearly this shows how easily misled gamers are..."
Don't worry, if it comes down to it, Notch will use the Chewbacca defense.

Take them down Notch. Attack them like an Enderman. They looked at you funny so now strike back and strike hard. Bethesda deserve it for such a frivolous lawsuit. It's the word "scrolls". It shares a single word with their title.
If that rule applies to everything Superman and Super Mario would be in conflict.

I don't like Notch as a person, but this time, I am really on Mojang's side. Bethesda's lawsuit-mania is just silly and goes against any notion of common sense. This is just ridiculous and a waste of time for all involved - including part of the Swedish justice system. Bethesda, please go facepalm for yourself, my hands can't accommodate this much stupidity.

The fact that people want Zenimax to win because they dislike Mojang is moronic. If Zenimax wins, this is going to bring back the same shit the Edge guy was shot down for.

Bungie should sue Bethesada because they are using the letter 'l' in their title if this makes sense.

The word "Scrolls" cannot be copyrighted, except maybe in the Insane-o World the guys that Bethesda's legal team seem live in. So no real case and will be dropped. Points to Notch for standing up to the big guys.

Gee I wonder if Beth's gonna try to use quotes from user comments on this ars technica article [http://arstechnica.com/gaming/news/2011/08/trailer-for-scrolls-from-minecraft-developers-released-at-pax-prime.ars?comments=1#comments-bar].

That's like saying Microsoft owns the letter X because of the name of their console! Or Gamestop owning the word stop! PEOPLE ARE IDIOTS!

Is this going to be handled by the Swedish courts? I certainly hope so, cuz they're brutal! They'll scream at Bethesda for even bringing it up, call them morons, and throw them out of court. That's the Viking way!
You know what? If they get the right judge there is an, albeit small, chance that they could actually settle this with a Quake match.
This needs to happen. Also Sweden is now about 90% more awesome in my books for not taking cases like these seriously. IT'S A WORD!

[sub]I wonder if the original creator of the word could sue EVERYBODY...[/sub]

I hope Mojang Wins, not because they made minecraft, but Because I think Bethesda are being complete morons and in their own way Insulting consumers intellegence.

Game is called Scrolls, Those dumb customers might think its our game and it isn't we better spend a ton on legal fees to sort this out.

The Ironic thing is most people I know, know of the elder scrolls games, and Can Identify them, but they call the game by its subtitle. It isnt The Elderscrolls 3,4 and five it is Morrowind, Oblivion and Skyrim.
Exactly. Everything here is precisely why I hope Mojang gives them an epic beatdown. Seriously, what the hell, Bethesda? I like your games, but this is just ridiculous. Stuff like this is one of the big problems with our legal system, and you just have to go and add to it, don't you?

The case against Mojang's Scrolls is paper thin. Persson should counter sue Bethesda just for emotional distress and compensation for lost productivity due to these pointless court hearings.
Your reaction to frivoulous lawsuits is to make more of them in revenge?

I wonder if this is not so much about Bethesda's fear of trademark infringement as it is an attempt to get a sneak peek at what Mojang's working on so it can be copied: Regardless of the outcome of the trial, Mojang will have to reveal details of the game in order to defend itself; Bethesda then uses this information to get a head start making a knockoff in the hopes that magical Mojang money-lightning will strike twice.

Off-topic: I'm not buying elder scrolls. I had never planned on buying it to begin with, and Bethesda's doing this isn't helping to change my mind.
