Hrm. Should this action really be considered "censorship"? I mean, it's not as if they are preventing the material from proliferating. It seems to me to be well within the bounds of "protecting their brand" by reducing unwanted correlations, which is kind of the purpose of branding/trademarks in the first place. If I had to guess if it went to court, I'd say Nintendo would win because it is not only their right but their duty to defend their brand and marks, and free speech doesn't even factor in because they aren't even challenging the material.

More specifically, "freedom" isn't license for anyone to do "whatever they want" - for instance, Nintendo has the freedom to build their own brand (unless of course it conflicts with more powerful freedoms, such as freedom of press).

Long story short, I don't see why this is a big deal. At all.

If Nintendo doesn't wanna be associated with porn, then they're gonna have to wage total war on Rule 34. And even then, Rule 35 would be implemented.

This isn't censorship, I'm very much against censorship but I have no problem with this. All they are asking is don't use tags and descriptions related to Nintendo's products on your porn site. There is no reason to do so, unless they actually are trying to capitalize on their products popularity to get hits, which would be doing something wrong. Otherwise it doesn't affect them at all to remove those words, but leaving them does piss of Nintendo.

This kind of misses the issue. It's not porn they have a problem with, it's their brand being associated with porn; in this case, who in their right might thinks any Rule 34 porn comes from, is sponsored by, or otherwise is supported by Nintendo? (In contrast, I doubt anyone would bat an eye if EA hired strippers to promote a theoretical Dante's Inferno 2 - if they haven't already for the first game! I wasn't paying much attention to that, but I digress...) This is what they're fighting against, not porn - which is evidenced by the request to take down only the references to Nintendo, rather than the content of the site.

It's a fine line but a very important one.

Well, they did make a Wii sex toy attachment ha ha! Even still, it doesn't take an individual too much creative effort to eroticize a lamp post, let alone a motion controlled "simulation" video game device with any form of external controller (seriously, anything would probably do in this world; Nintendo just made it more convenient with the Wii-mote).

I seriously do see Nintendo's side in this matter, as they have a product being associated with something they oppose by an independent third party. Still, a part of me enjoys the thought of Nintendo's family friendly ethos being paddle-slapped into submission by the association with any imagery and content that is against this company standard. But then, that may just be my personal vindication against gratuitous "family friendly" marketing of shovelware.

To be fair, a game officially published on a Nintendo console can be directed towards it's intended audience by having it rated as "Mature" and thus warning parents of it's violent content. When it comes to search engines, however, Nintendo has no way of preventing young kids from seeing mature content. As such, preventing mature websites from being associated with their products is preety much the only way they can preserve their image online.

Besides, Nintendo is no stranger to nudity (it goes without saying, but Not Safe For Work):
