Because if your console fails, has parts replaced and you play it, then the anti-used games DRM kicks in and reduces your entire games collection to a useless pile of plastic. I mean, that's like buying a house while a loonie with a disturbing grin and a box of matches is posted permanently outside it.
To me it seems the factor of which developer has the worst anti-customer policies should play a large part in the decision what one wants to buy.
I don't believe it will be that bad. I'm quite sure as the issue of downloadable content becomes a hotter topic, the EU will force companies to offer a better deal for the consumers. Where it's probably going to end up is that the games you have bought physically/downloaded will be registered to your user profile, and that you somehow are allowed to redownload/reuse it if your console crashes (given that you can provide the necessary documentation). Obviously, SOME sort of procedure in regards to this will have to be created to protect the consumers. Historically, consumer rights are very strong here in Europe, and I have no doubt that the EU will not have Sony or Microsoft come up with such a scheme that games will be limited to one system only, that is just pure madness.
What I'm actually MORE concerned about when it comes to digital downloads/accounts and such, how is this to be handled when the owner of said content dies? Will relatives have the right to get access to this content? Will they be able to sell it off in some kind of way? Obviously these things will need to be looked into sooner rather than later.
As for Sony implementing some form of an anti-used games policy, I have no problem with that. I never buy used games anyway, as nowadays I only buy the games I REALLY wanna play, and obviously I want to support the developer of these games, so I buy new in order for them to get their much needed profits. In the end it's about what games I want to play, and Sony's exclusive content blows Microsoft's out of the water. I mean, just look at this generation alone: Uncharted, Yakuza, Killzone, Resistance, inFamous, Heavy Rain, The Last of Us.. I probably even left out some. Ultimately though, I will buy the console that has the best games, and if Microsoft somehow can change this trend, I have no problem buying their console instead. This generation I bought both the 360 and PS3, but given the lack of exclusive content on Xbox, I doubt I will do the same next generation.
