Asides from the porn though.. isn't all this copyright infringement? and the infringers ARE making money out of it, so what makes them so special they don't get sued, but mothers and children do?
I guess I could further imply that I've seen my fair share of these by telling you how they avoid that. They only bear a striking resemblance to the characters in the show, use a theme song that only almost sounds like the original one, don't use any copyrighted logos and use names that only sound similar to the ones in the show. Thus, legal problems averted.
I very much doubt it's different enough for the issues to be averted.. in fact it's not different at all, apart from the T & A... they use the likeness, the voices.. and above all the REAL name of the characters and the show (they also use the real names and likenesses of the characters in their superhero porn).
If what you said was relevent to the 'products' were talking about (what you said was quite true... but what you said doesn't hold true to what's been done) then yeah.. I'd certainly admit your point.
I think this all boils down to not wanting to pick a fight with an industry that's collectively worth more than they are, remember the porn industry has some pretty big pull unfortunately.. they don't mind 'fucking' the little guy (pardon the pun)... but they're not about to try it with someone who can afford better lawyers than they can.
I think if some private citizen had enough money then they could force some 'fairness' in the situation by protesting this matter.... I'm pretty sure the law says something about having to reasonably enforce your copyright or risk losing it.. and allowing someone else to publically make money by copyright infringement isn't reasonably doing so.
Yet another case of one law for the people and another for industry.
