Except backwards compatibility. And now alternative OSes. It doesn't bother me personally but it feels like Sony have been gradually removing features as they've added others.

Maybe yours doesn't, but mine swings full BC juuuust fine. It's what we call early adoption. Usually gets you all the bells and whistles that folks complain about being removed years later.

I'm sure it's tempting to wear early adoption as a badge of honour after suffering all the commensurate expense and disadvantages. However, the general idea is products are supposed to get better and more feature packed over time, not less. What if your original was to be destroyed in a house fire? You'd be in the same boat as everyone else then.

the problem is that if you read the eula at the back of the manual sony reserves the right to change ANYTHING about how the ps3 operates at any time and without prior notice. if they continue to advertise the other os option after the fact then someone would have a lawsuit for false advertising, but as it stands there is no potential lawsuit.

I'm sorry, but in the UK this move essentially makes the PS3 unfit for purpose. At the time of buying the PS3 it advertised the ability to have a second OS, if they remove that then they are breaking the buyers statutory rights, not taking into account European law which would also be broken.

You accept an EULA, yes, but when you buy a product you are making a contract there too, one which stipulates that the product will act as intended and as advertised. When they took away the other OS option the PS3 no longer worked as advertised and that contract is effectively being broken.

HOWEVER, this lawsuit is in the us, not the eu, and here in the us the eula is a legally binding contract (technically), and because of that and the fact that sony reserves the right to modify their software this suit has no bearing unless sony advertises the other os option after the fact.

Uh, most of that info is the us version of the eu, the Lanham Act (title 15, chapter 22 of the United States Code) is a piece of legislation that contains the federal statutes of trademark law in the United States. The Act prohibits a number of activities, including trademark infringement, trademark dilution, and false advertising.

Basically to advertise a machine as "a system that can play games, play dvds/bluerays, install other os for a computer" then take away one of those functions after the product has been purchased, even if that function is not widely used, even with the eula, is considered a form of false advertising. The customer is not getting what was promised at the time of purchase.

Probably skimmed and missed it. I just get tired of people "arguing" when what i am doing so trying to Prove them wrong with very little opinion. Such as the Statement Coffee is hot opposed to I think Coffee should be hot or Coffee is best served hot. I don't drink Coffee and only time i know coffee to be Cooled or Cold Is Iced Coffee. 180 F isn't even Boiling. As Stated Earlier i have had Boiling Water hit me and with slight knowledge avoided all burns and had Redness. Most injuries in the kitchen when it comes to Heat is actually caused by steam. When it comes down to the EULA they did state they could remove utilities. I have not seen Advertisements stating Other OS capabilities. Its on the Older Boxes but i have yet to see it advertised. If a Big company, lets say Microsoft, Decided to Change the Disc Drive and you could no longer play burnt Movies or Non Compatible DVD or CD's they would most likely get a Class Action Lawsuit against them. BUT! they are within every right to protect their console and the games that are released for it. By doing this they might just remove all the Hacking that may happen in the future. As it stands now you can hack the 360 for around 20 dollars. Don't know if i missed anything....Oh the Judges. Why don't they send out a firmware/security update that stops the exploit.

Because once the first exploit has been successful, it's an uphill battle to keep on top of firmware updates that will counter new exploits while also maintaining compatibility with older games [that is, if the developers aren't going to patch their own games, which they WON'T...at least not on a weekly/monthly basis]. That is, of course, assuming that exploitation of the system garnered through an alternate operating system could be translated to the proprietary operating system...

If you already run strictly off of another OS, then firmware won't do jack...firmware only update the proprietary OS.

Not to mention that system update are still voluntary, even if not installing them reduces functionality of your machine...there's no way to guarantee that those who would exploit security weaknesses would then go and willingly download the updates that patch the holes in the fence.

I didn't see an explanation as to what the exploit was in the OP. Could you enlighten me or should I defer to google?

George Hotz has, through an installation of Linux, bypassed the PS3 Hypervisor [which prevents low-level hardware access from "another OS"], allowing him to have complete control of the machine; read/write capabilities, full processor access, and firmware stalematability. The exploit is so direct and complete, that Sony wouldn't even really be able to release a patch that could directly counter it, just make it much more difficult to employ.

Yes people this is the HUUUGE security flaw that Sony is freaking out about. A system modification that had to be done WITH A MICROSCOPE AND MANUALLY MODIFYING THE CHIP.

So whats Sony do? Freak out and nuke the other OS, where he was pulling data from.

Ford says no, comes over with a van, and removes all your upgrades. Then they want you to install a new computer in the car that prevents you from ever customizing or installing anything that Ford doesn't want you to use, and if you don't, you can't drive faster than 35Mph.

I couldn't care less about BluRay and DVD support. I play games on my PS3, not movies. Someone else might give a rats ass, but not me. Besides, those are features that Sony would have to be suicidal to remove. Very few people actually knew the PS3 even had the Other OS option in the first place, and even fewer actually used it. Why should Sony keep a feature that most people don't care for, especially if you take their word for it and it actually is a liability to security? Sure, you probably have a right to be angry but a lawsuit is hardly a justifiable response. Just do what that Amazon guy did and try to get a refund.

Also:
I'd sell the Ford Mustang to someone who actually wouldn't mind putting up with that crap and buy a car from some other competitor like I should have done in the first place because I don't even like Ford.

Just a quick question... Did Sony ever actually make any reasonable profit off the PS3 console? I know they made a huge loss off the first batch of phat units, but I'm not sure if they managed to recuperate the losses they originally made.

Since the lawsuit is requesting "disgorgement of all profits unjust retained by Sony", doesn't that require that they actually made profit in the first place?

The PS3 and x-box 360 both lose money on each sale but this is made up selling rights to make games.(PS2 and xbox did this too)
