You don't have to create it to control it. It's possible that he used an existing bot net, but not likely as he was convicted of distributing a virus, and he wouldn't have if he didn't have a hand in creating that bot-net. You don't infect each computer individually either. I pretty much agree companies are being given to much leeway with their products and services. It seems to be a continuing trend that our lawmakers do not have enough technical knowledge to fully understand the ramifications of the laws they are creating.
