In cases of sexual assualt the legal system fails as there is usually far too little material evidence and a great many ways for the defence to claim "sex yes but rape no". As I said I have no issue in general with the "innocent until proven guilty" philosphy but with sex crimes it is insufficient to provide a satisfactory system to convict the guilty and protect the innocent.
This is why I consider trivialsing rape in the manner that you seem to think appropriate is so damaging. I dont have a problem with people joking about murder because people who commit such crimes are brought to justice in about 90%-95% of cases. In cases of rape justice is the rare rather than the common - and society by and large does not recognise this fact. For exactly what reasons I am not going to specualte upon here.
Suffice to say for myself, having never been a victim of rape but understanding it from the perspective of some who have, I would deem humour around sex crimes to be not just trivialising, but damaging to the chances of victims to recieve any kind of justice. It is also for this reason I would give anyone who is found to be fabricating a charge of rape to get a sentence in line with a rapist.
If justice is not seen to be done then justice ceases to deter those who would succumb to its temptations.
Are you serious? Take a step back and really look at what you are arguing for.
The problem is that rape victims often don't report the crime right away. There is plenty of physical evidence, but most of it has to be collected right away or it's useless. Encouraging victims to speak up as soon as possible, pushing back those who ridicule the victims, making sure the cases are taken seriously. All of these would increase the conviction rate. Wild changes to the law and legal systems will only serve to throw innocent people in jail.
Also, there will never be 100% conviction rate, because sometimes the prosecution is wrong. A rape may not have occurred. Now wait a second, I agree that more guilty get off then innocent, I just do not think the correct way to fight it is overthrowing innocent until proven guilty.
And to the first guy, CONGRATZ you really DO have a phrase guaranteed to start a shit-storm. I'm not sure whether to commend you, or condemn you.
