There wouldn't be any legal issues with them fighting. Many Pokemon are nearly as intelligent as humans, many are even smarter than humans. And they enjoy fighting with each other. Think of the Pokemon as professional fighters and the humans as their trainers.

If the question is using the pokemon from the anime, then humanity wouldn't exist.
If the question is using the pokemon from the games, then we'd have PETP if the world wasn't already destroyed by some cult using pokemon to sink all land/drain all water.
