Nolo contendere is a plea entered in criminal cases by the defendant. This is not a criminal case, nor is this man a defendant. The plantiff does not enter a plea in civil cases. If he drops his suit, or settles out of court, no precident is established.

If this actually goes anywhere, I wish him luck. I absolutely hate the "the Terms of Service are subject to change without notice" part of so many contracts. Practice like that should be illegal. And though I know there's no way he'll get the absurdly large amount of money he thinks they owe him, even if it ends in settlement it'll make things change.

That, and the fact that nobody even reads the terms of service anyway, and that's because:

1.The TOS are made as long, complicated, and boring as possible, far more so than they need to be so that nobody WANTS to read them.

2. They all say roughly the same thing, and that is " do not infringe on our copyright, and our company is not responsible for anything that could possibly happen, even the things we are clearly responsible for."

3. Unless they happened to work in law, nobody is even going to UNDERSTAND the TOS to know whether they're going to be screwed over thanks to overly and unnecessarily complicated legal jargon.

As for this guy, he's neither going to get 500 Billion or make a point, this is going to be immediately thrown out by the first judge that sees this case and have no impact on either corporation's business practices or any laws whatsoever, this case isn't going to accomplish anything at all.

Idiot, should have given them 90 days to respond (think thats a usual time frame) instead of a day. It's like saying "read the entire works of Shakespeare in less than an hour or you owe me £10 trillion" there is no way it would have been physically possible for the letter to be reviewed and responded to in less than a day; It would take about a week for the legal team to find all the case law alone. And they are not going to respond with legal answers without knowing where they stand.

Unless you're applying for a job that requires extensive social skills, Asperger's is not going to hinder you, mentally or physically. And even then it can be overcome, and you just wouldn't be getting the job because you can't do it, not because of discrimination.

Millions of people successfully hide Asperger's for years, or even their whole life. It's a crutch excuse for something that can be overcome(poor social skills). And yes, I'm talking about people who have actually been diagnosed by a doctors as well as the stupid self-diagnosis people.

I half wanted to sue some employers for discrimination, particular when it was an easy enough crap job I was doing fine, and they gave the most bullshit reasons for it. Granted I didn't as I figured I'd never win it, and I'm not fully sure that was the reason, and particularly I didn't know I had it at the time and did not disclose it which would have probably covered their asses even though they may well discriminated against me for stupid reasons which that is just related to my disorder.

Besides, even though society screws me over fairly royally, repeatedly for shit I can't help like this, I don't act like a dick to other people and assume they should bend over backwards for me for stupid things.

Honestly I want to hurt this fuck, even if he really is an aspie, he's also a colossal asshole and is making us all look bad, regardless of whether or not he actually does have the disorder.

Thing is he has absolutely no intention of winning at all. He is being a dick and askng for a completely hopeless amount of money for the sole purpose gaining attention that can be directed to asinine business practices related to the EULA/TOS agreements. Agrees. Suing a large company when you have been wronged makes sense. Suing a large company, for inane amounts of money, just because you can, is a pretty lousy thing to do. It's easy to think of a corporation as a giant faceless entity, but the fact of the mater is that these said corporations supply thousands of jobs and services, not to mention the several hundred thousand people that gain income from their stock holding in the company. Suing for some asinine reason, which can probably be boiled down to a desire to hurt the company, is just plain wrong. And, if by some cosmically wacked turn of events, this guy won, you can bet that the company would downsize, thousands would lose their jobs, and goodness knows how many projects and programs would be cut. Regardless of how much a corporation might urk you, that's nothing compared to jerks like this guy.

He's not actually doing anything worse than Apple, Microsoft, Sony do every day. Their EULA's are chockful of jargon that are sometimes...playful with their legal ramifications, and even the Miranda warning ("You have the right to remain silent") isn't legally binding unless you understand it fully. (Which is why the Police have to be sure that you've heard it)

Now this guy may, and probably is, way out on the con; but in doing so, he may inadvertently put restrictions in motion that stop Microsoft from, say, banning you from Xbox from a false positive from their cheating system.

Because at the moment, you have no recompense to that apart from a call to PR.

Obviously, major companies need a certain leeway in defining their terms and conditions - and obviously legal precedents override legal loopholes, but actually having court cases that the lawyers can bring up to say "Hold on a tic, you said in blah versus blah that this couldn't happen." may yet be a gain for the legitimate consumer.

I agree that there have to be rules for companies as well as for citizens, and it would be nice if they were fair all around, but under the current rules, what exactly prevents some Microsoft lawyer from going before a judge, shrugging, and saying, "Oh, that? Yeah, we changed the contract right back five minutes after we got the letter, just figured his continued use of Xbox Live was implicit agreement on his part."
