Let me introduce you to a concept called confirmation bias. You want to believe that the US is stupid, so every time you see a random news article you think to yourself "Boy am I right!" Then ignore the fact that it was one out of hundreds of thousands of stories, not all negative.

Don't worry you are not alone, this is the same thing that lets skeptics always be skeptical, that gets people believing in psychics and conspiracy theories. Everyone has it.

Wait a minute...oh there is no such law! Coffee temperature is a matter of opinion. You can argue its against good judgment, but if you go there you can always bring up how some places are chilly/hotter temperatures than other...

Man...i'm starting to think some people here would vote in favor of Estavillo...while his definition of suffering may not fit with some, perhaps other believe him.

The only real legal danger he faces is losing. He won't get counter-sued because big corporations 'bullying' a single person over something small and trivial is nothing but bad press, regardless of how much of a douchenozzle Mr. Estavillo is.

Note that I said 'look stupid', not 'is stupid'. I never said the American legal system that allows citizens to sue corporations is stupid, just that this case makes it look this way.

It wasn't that McDonald's broke any coffee temperature mandates, it was that McDonald's, despite numerous complaints regarding the extreme temperature of their coffee (some also involving third-degree burns), which was found to be so hot that it was actually unfit for human consumption, did nothing to remedy it. McDonald's were beyond a doubt aware of the health risk of spilling coffee at the temperatures they served it - up to 190 degrees F, and yet they had no intention of lowering it, as their consultants had found 190 degrees to provide "optimum taste", never mind that it was, as I earlier stated, unfit for human consumption.

So no, they didn't break any laws. They just served their coffee at absurdly high temperatures with reckless disregard for their clients' safety and refused to pay the medical bills when asked to, despite it having been shown during the case that coffee served at the more normal temperature of about 155 would have posed an exponentially lower health risk. There's a subjective "too hot" and then there's the objective "no human could possibly drink this safely".

I read about this guy day in and day out and I think he's going to sue the internet for being mean to him and then sue the Asylum hes in when they take his crazy ass away for keeping him against his will. Then he'll sue his next cell neighbor for being to loud and the guy across the hall for being to quit. And, not to sound ignorant here, what is an agoraphobe anyway? I wondered this because agora means pain in latin, that's where "being agroed" comes from, and phobe means fear. So is it fear of pain, or is it something else?

People can complain all they like that McDonald's sells its coffee too hot, but you only need to know one thing about the case: the stupid ***** put it between her fat thighs and started driving. Even if it was normal boiling temperature, would you purposefully scald yourself by upending a kettle all over your lap? No. She would have still gotten burnt even if it had been at 'normal' temperature, so the ***** doesn't have a case. Oh and you know how we all laugh over the signs saying 'Caution: Coffee MAY be hot'? I'm sure that, if they didn't put the 'may' in, some asshat would put their coffee in the fridge and then complain it was cold...

There needs to be a "Erik Estavillo Law" that stops frivolous lawsuits such as this before our tax dollars get wasted even further. Stop this jackass!
