The way your argument is going is a stupid way. Simply because you cannot trademark something as miniscule as a character. Hell they could be the same name same look. But you do know that as long as the character for DoTA 2 is not CREATED FOR DoTA 2 as in coded and created through use of the WC3 map editor it does not fall under the useless wall of text you posted.
You know they are trying to copy hero model and items Icon as close as WC3. Those Model and Icon belong to WC3.

I know law don't protect "concept" well, but if you read the title you found it is a question of "should" or "should not", not Legal or illegal.
AS LONG AS IT IS NOT EXACTLY THE SAME it doesnt fucking matter. Why? Because according to the wall of text as long as it is not created in WC3's Editor it cannot be challenged. Who is to say Valve is even going to charge for this game anyway? Huh? We have no idea what Valve is planning on doing with the DoTA IP. We have no idea what they are going to do with this game either. Seriously? Yeah the IP should stay with the community and not be taken by a company since it was CREATED by the community.

Pissed they didn't think of it first.

One more idea Kotick will love though, copyrighting other people's ideas and getting money for it.

Awesome. ¬_¬
They had years to do it. The point they're making is that no one should own it.
Would you rather have nobody own it and there be no sequel?
Or Valve (who can do no wrong) own it and release a kickass sequel? :)
Wow, Valve can do no wrong? You really sound like a fanboy. They don't need to trademark it to make a game out of it. The only reason they would need to trademark it would be to keep everyone else from using it. Which they have no right to do considering they had no part in creating it. And no I'm neither a fan of Blizzard or Valve, but based on my observations, Valve is in the wrong. It's a community project and it should stay that way. If Blizzard understands this why can't Valve?
Half Life, Left 4 Dead Portal, Tf2? That's what I mean by Do No Wrong.
Their games tend to kick ass.
If there is anyone you want making your game, it's them.
...Ok, so they make good games. That still doesn't give them the right to trademark it.
True. But the original creators haven't really said anything negative about Valve.

If they were assholes and there was no copyright, they could wait until the game was made before suing Valve for many, many dollars.

Plus, you're forgetting that a lot of Valve games are based on community mods. CSS for example.
A community mod. Which was bought by Valve.
And made into a franchise.

You obivious isn't following the DotA news... We do have idea what Valve is doing.
In it the concept art of a hero look very alike to the WC3 version.
And trademark is called TRADEmark for a reason, meaning People want profit from it. Or why bother.
They are planing on custom skin, so I guessing it might be micro-transaction or full paid game + micro-transaction like TF2?
anyway TRADEmarking it means they want profit from it one way or another.

And I already told you this is not about legal or illegal but should or shouldn't

Becareful it is a big "stupid" wall of text.

Be careful it is a big "stupid" wall of text.
First off you just posted something from Gamestop. Second trademarks do not necessarily mean money. Trademarks can also mean just getting your name attached to a product THATS IT. Whoopdi-fucking-do the characters are looking the same BIG FUCKING DEAL. So your telling me that if FFX and FFX-2 had completely different characters it would of been just fine? FUCK NO. Seriously if its in the same universe following the same principles I would expect there to be the same characters. Hell if Max Payne and Max Payne 2 had two completely different characters people would still buy it? Yes but they would complain like fuck about it. Hell we are giving Valve EXACTLY what they want from this because we are keeping the news relevant or did you not notice thats what people tend to do now? Kill me if I am wrong but that is what Bobby Kotick is keeping Activisions name in the news and relevant because they haven't really put out a good game recently. Hell Valve fans are getting pissed because Ep 3 isn't out yet. You can keep arguing that Valve is EVIL but all they are doing is keeping their name relevent indie developers do not have shit loads of resources to keep going if they start to lose money. Hell for all we know DoTA 2 could be a fucking code name and the pictures they send out completely false and then release some amazing game. WE HAVE NO FUCKING IDEA WHAT THEY ARE ACTUALLY DOING! Stop trying to act like you do.

*EDIT*
You are going by them going for the same look as the heroes by the pictures and the pictures alone. -.- really? REALLY? Seriously now just because FAMILIAR characters are shown does not mean there won't be new ones too the article doesn't really say anything besides the guy who works on Allstars is the one that is doing the game. Well for originality we can't get angry at Valve anymore but more at Icefrog.

It is from Game Informer? And they actually played it and Interview Valve... Did you even read it?

I HAVE CAPSLOCK AS WELL.

Do Blizzard TradeMark their Free maps? No.
Why Trademark something if you are not going to use the trademark... The Protection from Trademakr is about profit.

Game Informer is owned and put out by gamestop.
Anyone can really trademark anything as long as they have reason to so it doesn't really matter what we think about it. Hell its now Activision-Blizzard vs Valve.

Very true, but trying to trademark doesn't mean it is going to pass, just saying.

No one's really addressing the point that Defence of the Ancients isn't being pursued. Just DOTA (in all caps, to boot).

What do you think Dota stand for...
The whole community always refer Defence of the Ancients as Dota.

However Pendragon is trying to get the trademark for Defence of the Ancients after Valve is trying to get the trademark of Dota. Last time I check both of them have not passed yet. Time will tell.

I think Valve should just forget this nonsense and make Episode III.

No, I will not allow a single Valve thread to go by without some mention of Episode III. Sorry. : /
Meh it's not like Half Life is the best game out there. It's good, but can we move on. I'm sure there has been many games you've liked since HL Episode 2....

And if not, well wtf have you been doing for the many years since Episode 2 has come out XD. Keep doing it.

(If it was sex, well... your better off XD)

I'm not reading 11 pages of comments to see if anyone else is thinking the same thing, but I think Blizz needs to STFU. These comments are coming from the same company who put in their mapmaker EULA that Blizz owns all mods made for Starcraft 2. So all I'm hearing is them whining because they mustn't have had that clause in the War3 editor, or Valve would not have been able to pull this off.

To be fair, it is a little underhanded for Valve to trademark it, but if it becomes even greater like CS or TF because of the support Valve has, then the Warcraft 3 community needs to also STFU because some one did them a favor and made it better.

Divided Over The Apocalypse? Death Of The Adversaries? Divisions Of The Andropia? Departments Of Terminal Altitude? Defenders Of The Artefacts? Destruction Of The Antagonisers? I could go on. The point is, I don't think Blizzard has a case to stand on that Valve can't hand-wave away in ten seconds.

All arguments aside, there are really only three outcomes here:

Valve gets the copyright, Blizzard gets the copyright, or Dota remains free.

Valve has a history of making people pay for (admittedly entertaining) mods, while Blizzard had the Ability to trademark Dota for years (It's in the Eula for the world editor) I personally prefer the third option though. Having several versions of Dota out would force Valve, Hon, and League of legends to be innovative and competitive.

As an ardent fan of DotA, I'm really looking forward to Valve's version. Especially since it is rumored that IceFrog himself will be collaborating with valve. But I do agree with Blizzard, Valve should just piss off and not try to trademark that name.

This is actually one of the developer answering a question. Because Blizzard is going to Release a free map called Blizzard DotA, so someone ask them if he know Valve is trademarking DotA. He answered he like valve's game but it is unlike valve to do such a thing. This all happen on live stream it is not the company's stand point or Actvision.

Blizzard own the SC2 map is because they are adding a feature called Battle.net Marketplace. Where User made map can be selled, so they have conturl over the maps. Just like Valve Mann Co. store they own thing sell there no matter if you design the item, in both case the designer do get a % of profit.

Also what give you the right to tell the War3 community shut up, Valve/IceFrog steal thier thing. If Valve/IceFrog Trademark DotA: Allstar then I would be ok,(as long Guinsoo(creator of DotA: Allstar) is good with it). But DotA belong to the community. Just because you have the biggest fan made DotA (that is DotA: Allstar) doesn't give you the name DotA.

It is not a rumor, IceFrog post it in his blog like 5 month ago about he is leading a team in Valve.
IceFrog later announced DotA 2 in his blog and his version of DotA site.

well it sounds less that they think it should remain free and more like Blizzard want it.
They keep talking about it being available to the "blizzard community" etc.
Valve have Icefrog and it was his idea to get the trademark and make dota 2.
And icefrog is the authority when it comes to Dota, since he did most of the work. Blizz has no say in this since none of their employees were even part of the development process.

Somehow I can't see myself believing Blizzards mentioning this out of love for the community. Feels like an attempt at a "be the good guy" stunt to me.

... though I was a little curious about Valve and the whole trademarking DotA, all things considered (community focused project, etc...)
They seem to be doing the same thing they did with counter strike and Tf and portal.
They hire the modteam and trademark it.
Counter strike was a mod once too. And now valve owns the devs and trademark.
Took the words right out of my mouth. Valve hires modders, giving them resources to create higher budget versions of their mods. They've been doing this forever. As a major PC game developer Blizzard should know about how Valve operates (or then again they've probably been too busy counting their WoW money). This doesn't "mark Valve's coolness factor" for me like some other people seem to suggest... it's ridiculous to hate Valve for doing what they've always done and we've praised them for.

Simply put, get over it people, and get over it Blizzard, DotA was never "yours" to begin with. It could just as easily been a Source mod, and to suggest that Valve is taking it away from the Warcraft community, maybe you should just suck it up and remember that you took Warcraft away from the warcraft community by making it an MMORPG.

Shuddup Blizzard, Valve knows how to please the Community. Valve owns that shit know, get over it.
I was definely pleased when they released Mann Co. a Micro- transaction to a pull paid game, how nice of them.
