You do realize he has paid his lawyers up till now right? And he said he would donate whatever is left over when he accepted the donations.

As long as the money is used to pay his lawyers up till now, and the rest is donated like he claimed up front, there is no fraud. And he sure as hell shouldn't pay it ALL back, it's not like the lawyers worked for free up till now.

Honestly, this seems like somewhat of a victory for GeoHotz, think about it, the root key got out, and he didn't go to jail or owe Sony millions of dollars, sounds like a victory to me at least.

That's not where the fraud occurs. The fraud occurs in stating that you will accept my money and use it to accomplish Object X and then deliberately failing to accomplish Object X. Plain and simple. The promise to donate a surplus to the EFF was the surplus left over after Object X was accomplished. But Objective X was never accomplished. Therefore, there's no surplus.
A donation is a gift. Sorry, brah, but Hotz can do whatever the hell he wants with the leftover funds. You should be more careful with who and how much you donate your money to.
As a legal matter, brah, some gifts are not given to the recipients for them to do with whatever they want. A donatio mortis causa (i.e., a gift given in contemplation of imminent death) has to be returned to the donor if they don't imminently die as they contemplated. Similarly, a gift given in contemplation of marriage (e.g., an engagement ring) reverts back to the giver if the marriage is called off and never occurs.

A little internet research before we open our mouths and get to talking about that which we know absolutely nothing, goes a long way, brah.

I'm so thoroughly regretting my empty threat to sue George Hotz for his unreturned donations. It has become a complete distraction from what is actually a cause for celebration: the fact that Sony has now completely owned him.

1)If he didn't intend on piracy why did he give out the master key to bypass sony to make it easy

2)If he is a master mind he knows giving people freedom means some will abuse it.

At first my opinion on consoles was that XBOX is greedy and PS3 is kind and willing to give users the best for the lowest price

Now my opinion is both company's are faceless soulless

Fine. It may not be practical to return the money. But there's still something about hanging on to it or even giving it to the EFF -- or Jerry's Kids for that matter -- that still strikes me as less than kosher. But that's just me.

Yep, this is very much a zero sum gain for both sides. The know-how and the key is still out there for people to rehost (and they probably have several times over), and GeoHot is still banned from publicly hacking his PS3. I wonder if the Internet Archive still has the offending pages?

Actually, while I will admit to frequent episodes of anger, today ain't at all one of those days. I thought I'd have to wait years for Sony to own Hotz. Turns out it took less than three months. Today's a good day, in my book, with absolutely no cause at all for anger.

I can't say they were on the wrong side of it legally, but Sony were in the wrong morally. However they were throwing a lot of money around to make sure they won the case regardless of morals.

I'm sure you heard about them infringing on personal privacy of anyone who watch Hotz's videos or visited his website, counting those people as criminals themselves. Hell they had my IP address because I was linked to a youtube video by the Escapist news team. They were going to screw him whether he was in the right or not. I can't blame him from backing down, he took donations and made a fight of it but he would have needed far larger coffers to win this. Admirable try.

You might be pissed now, but how pissed would you be if GeoHotz lost and Sony made some precident over EULA's so that any company may do what Sony did. Frankly, that looked to be the most likely course if this went to court.

Once again, Ladies and gentlemen, the guy who supposedly was fighting for your consumer rights simply goes with the agreement not to settle anything. Truly he lies up to the freedom fighting standard he had when this all began. Truly he will not let Sony intimidate him and change his resolve!

Ahh but I kid I kid. It's just so funny to watch the story as everyone rallies behind him and all plan his glorious march to freedom against the evil Sony and he doesn't do anything like that. I think an outside settlement was probably the best move for him since this case was potentially going to hurt him more then Sony in the end. The worst case for Sony is that Sony closes its gaming arm. The worst case for the dude is that he goes broke.
