I never quoted any laws, made up or otherwise actually. I don't doubt the laws you cited are real, but I do doubt your ability to interpret the language of said laws. First it was unjust enrichment, now it's fraud based on information only you have seen. I don't purport you would definitely lose, but I couldn't see a victory based on what you have said here today either. If anything, it would be fun to watch on Court TV. :p

You're trying to tell me that the client's attorney can make a decision to settle a pending lawsuit independent of his client's position on the matter and without any consultation with or agreement from his client? If that's what in fact happen, then Hotz needs to contact me so I can represent him in a malpractice suit against his attorney.
I'm sure he is trying to say that a persons attorney can strongly suggest that settling is in his best interest, and the client, not having a law degree, might just listen to them.
He might of been "trying" to say that but saying "it was probably his lawyer who decided to settle . . . and not Geohot himself" comes nowhere close to actually saying that.
I can't disagree with your overall assessment of the statement, that's for sure. In a court of law it wouldn't hold up in my favor on that one. Glad life isn't all about courts though, we might all very well be fucked.

I couldn't agree more with this post. Remember when he "fled" the country and ran off to hide in south america? Everyone who previously supported him jumped all over him because Sony filed a motion. People definitely need to learn to objectively read something and get actual information out of it, and not just here-say of one side of the lawsuit.
Hearsay, not here-say. You'll never join the ranks of big, bad-ass, Wall Street attorneys if you can't get simple terms of art right. : P

As it stands, Sony "wins" whether they "tied" or won.
-They still legally "own" your PS3.
-They got away with blatant fraud

Not that GeoHot's motives weren't questionable (I'm pretty sure his intention was piracy, but that's my speculative opinion); but I would have preferred to get some ground on the demarcation between "Service" and "Product".
Right now, Sony is having our cake and eating it too. There isn't a damn thing to do about it except not do business with them.

As I predicted before, nothing good would come of this case. And nothing good did.

I was really hoping Sony's way of handling the hardware they sell would finally be challenged in court but, then again, with how trials go these days, we'd probably be playing the Playstation 6 by the time this case would have been out of litigation. Someone soon should try get something like this to court anyways.

How about the part where he didn't guarantee this? He said it's what he wanted, which is not a guarantee by any stretch of the imagination. He said that he would fight for that, but once again, didn't guarantee this. He stated again and again that this was about sending a message, which is the one thing he did guarantee, and I would say, message sent.

Though, I am compelled to agree that there is no way in HELL Sony agreed to what he was asking.
And pray tell, outta curiosity, just what was the "message that he sent?" Because, while I'm sure that you'll disagree with me, on my score card I have Sony winning every round thus far and well ahead of Mr. Hotz on points. That he decided to throw in the towel and not answer the bell makes perfect sense to me. I saw a monumental ass-whupping in his future. So, again, I'm not seeing the "message" sent, unless the message is that if you're stupid enough to think that you and your solo-practitioner attorney can take on a multi-billion dollar corporation like Sony and its high-priced legal guns, you're not so stupid to call it quits before they beat you to a bloody pulp. It that the same message you think was sent?

Look here, Sport, as if I'm really gonna round up a class and sue George Hotz for the few thousand dollars in donations he collected. Please. I'd rather class action Sony on some bullshit claim I invented before I do that. At least there's real money in Sony's pockets. I may not be the sharpest knife in the cutlery cabinet, but even I can tell when the game ain't worth the candle wax.

Thank god, I was getting really fucking tired of hearing about all this. I was guessing that a settlement would happen, I never really was pulling for any side to win, it would've been rather ugly if either side would've won.

Besides, it was all getting rather silly on both sides. I was gonna start playing Benny Hill music the next time I was reading about more shenanigans happening with that case.

Basically Geohot can never do anything Sony doesnt approve of to any Sony product ever again for the rest of his life and if he does he has to pay Sony 10,000 and if he shares any of the info he will have to pay up to 250,000...

nope, cases settled out of court absolutely do NOT set any precedent in the American legal system. That's part of why big companies often choose to do it.
you're obviously the only one who doesn't look at a PS3 and think, "dam,n, that was a cheaper buy and more powerful than my computer BY A GOOD 400 DOLLARS... I wish I could use it as one."
