This man is literally the fucking devil. If the subscription only applies to newer Call of Duty games, everyone I know will just continue playing MW2. If it applies to all CoD games, then I'm sure majority of the people I know would stop playing.

Am I the only one who wants this to go through as Kotick plans? I hate MW enough to want it to fail harder than anything has failed in the past. I also want an excuse to not purchase, and waste my time getting to lvl70, only to realize, I just wasted my fucking time.

Short answer: no, there's no lawsuit there.

Long answer: The advertisements for XBL and any individual game are wholly separate. XBL advertisements specifically advertise features which exist on an "as available" basis. If a game doesn't support XBL or any individual part of it, the fact that XBL has those features is irrelevant.

If I buy a new stereo system for my car, but the person installing it tells me that I won't be able to us the A/C and the radio at the same time, I can't sue the original manufacturer of the car, nor the installer. Neither, technically, broke any promises. In full knowledge of the limitations, I gave up one aspect of the original system in order to access the newer product.

So, first you have to prove there is a contract (no small feat, since there's no real set standard for whether an advertisement counts as a contract in all cases, and since the EULA acts as an affirmative defense to that), and thenthat there has been a substantive breach (that is, a breach which actually diminished your ability to reap the full rewards of the contract).

Finally, you have to prove damages. Here's the thing: there aren't any damages anyway. In a suit brought in contract law, the only remedy is to be "made whole", you can be returned to the economic condition you would have been in were it not for the suit. Now, prove that you never would have bought the game without party chat, and you might be able to get a refund... That's about it.

Finally, "infringement" is the wrong concept here. Really, you can only infringe on a right which is pre-established. Since the only "rights" which exist in a contract matter are rights established between the parties, you don't "infringe", you either breach the contract or you don't.

Not reasonable. It's free on Playstation.

Call of Duty is effectivley dead to the true fans. It got too huge and it imploded. All the original creators are gone and now they are being made by the B team and now we're expected to pay monthly? Pah! I think everyone will be just fine with Medal of Honor, Battlefield, MAG, Halo etc.

Hate to play devil's advocate here, but why when MW2 became the biggest game release of '09 did everyone decide to kick-start the COD backlash? I've played all the Infinity Ward-developed COD titles, and they've all been fun games. Yeah, MW2 has a lot of flaws, but I can't say after playing I feel like I wasted my time, at least no more than playing any other video game. That said, I've all but lost interest in the franchise at this point, so I could really care less.

Sorry Kotick, I could've forgiven the price hike for Modern Warfare 2 but I could never have forgiven getting rid of IW, and now this. You are, without a doubt, one evil dictator. Gaming is not your god damned ***** for you to fuck with! Gaming is not a cow for you to milk money! Gaming is a culture, and it seems that developers like Blizzard, Valve and Kojima Productions understand this. Obviously, you do not. Now, go sit in the hallway, play some Half Life, Portal, Metal Gear and Zelda then call us back. Don't touch Blizzard games, you'll just find a way to fuck it up since that merger.

I will never ever pay a subscription fee for anything other than MMO's(who put out months of fresh content every few months), Kotick is freaking dreaming if he thinks people are clamoring for this.

I'd rather play BC2 or MoH on principal.
