Technically, under this wording, there could be some insane restrictions placed on pregnant women. In addition to the no smoking/drinking/drugs thing, anything else that could be seen as harmful to the baby could also be prohibited. Things like coffee, herbal tea, potato chips, excessive exercising, going to places where you could likely be exposed to bacteria and diseases, getting in a car (which could be in a crash), etc...... so long as there is no human involvement whatsoever in the causation of such event.
In extreme cases, you would basically be stripping away all rights of the woman involved under threat of being charged with murder of her child should something happen.

To me, it looks like one crazy person proposing something incomprehensibly stupid, and these commentators using it to demonize the entire pro-life movement. They didn't just say "this guy is an idiot", they started Republican-bashing, acting like this is normal conservative behavior, and it's a "war on reproductive rights".
