The agoraphobic PS3 owner who sued Sony because he was banned from the PlayStation Network has launched two new lawsuits, this time against Microsoft and Nintendo.

Erik Estavillo appealed [http://www.escapistmagazine.com/news/view/93314-Agoraphobic-PS3-Owner-Sues-Sony-over-PSN-Ban] the dismissal and also filed a second civil suit against Sony for $180,000 in damages.

Apparently not wanting anyone to feel left out, Estavillo has now filed suits against the other two console manufacturers as well. He's seeking $75,000 from Microsoft as a result of his console being hit by the Red Ring of Death; he can't afford to repair or replace the unit because he's disabled, he said, so he's seeking compensation for the "undue stress" he's suffered since the demise of the unit and the "sadness he will have in the meantime of finding one he can afford."

His lawsuit against Nintendo, meanwhile, centers around the 4.3 update to the Wii firmware, which disabled the Homebrew Channel. Estavillo used the Homebrew Channel to unlock characters in Super Mario Galaxy [http://www.mariokart.com/], essentially "forcing customers to buy another game to unlock one character in a different game." Estavillo is seeking $5,000 from Nintendo as well as an injunction against "deleting, blocking or prohibiting the Homebrew Channel and Ocarina applications."

Estavillo, who said he also suffers from depression, obsessive-compulsive disorder, panic disorder and Crohn's disease, plans to file similar lawsuits at the state level as well.

That's a fantastic idea... i reckon we all need to Sue Sega until they make a Sonic game to the standards of AT LEAST the Sonic Adventure 2 Battle, and generally stop putting Sonic Cameos in just about every other game they've made.

Sega, your Mascot is dying, at least try to reach for the Defibrillation!

Okay, due to his mental and physical conditions I am going to be more leniant on this man, but this is still a very facepalm-worthy story.

I mean, if you break the Terms of Service, then a company has every right to deny you access afterwards.

As for the Microsoft thing, &75,000 seems really excessive even considering the agoraphobic nature of the man. And as for Nintendo... well, any real Nintendo gamer at this point will have gotten them both anyway. Actually if they're anything like me, they'll have Super Mario Galaxy, and NOT Mario Kart Wii. The AI is so broken on that game...

I'm wondering why he'd get Mario Kart Wii, actually, that game is pretty much a gigantic atomic frustration nuke or something, especially on higher difficulty levels. At least as far as I've heard; it very well could be if it's anything like how Double Dash was.

Although I find it interesting that he can't afford to replace his 360 when he apparently could afford all three consoles in the first place, plus games for them.

Likewise. Normally I'd spew bile over people like this, but you do have to consider various mental health problems... this man really does need some help.

Oh hai, I hear you don't have loser pays in your court system over there.

You know why it's always America where this shit happens? Because in most countries the loser of a court case pays the full costs for both participants.

as for nintendo if anyone should be in trouble it is him there was a reason his wii got bricked because he broke the rules!

Last time I checked all three companies had no lawyers on their payroll so I'm guessing he will win all three!

Maybe if he stopped being a **** online he wouldn't have the first of these problems. Tard.

For the second one all he has to do is to phone up MS, ask for a box and put your Xbox in it, then get it picked up by an external company if MS wont do it but they probably will. I'm sure he can open his front door a few times.

This just goes to show that he has no real standing on anything. I like how he's more disabled now than he was when he was suing Sony. The depression and other things wasn't even mentioned back then. Also since his filing these on a local level too he's hoping that some dumb judge may feel sorry and award some money or maybe he's hoping one of them will settle.

If it came to the point they needed one any of the three could get one with ease. Assuming he's still doing this the way he was when he filed that second suit against Sony, then he doesn't have a lawyer either.
