If that's the line that was taken, then his lawyer is an even bigger douche for taking his money to pursue an unwinnable case. Not only is there massive precedent for the First Amendment not restricting the activities of private organisations, it's there in the wording of the amendment itself.

Now that I can accept as a fair case. McDonalds specifically keep their coffee at higher than normal temperatures and have refused to fall in line with H&S recommendations due to "customer desires". If you're deliberately ignoring the law, then you deserve to be reprimanded.
