The American government doesn't back and is not above the laws of the ESA any more than Canada. If I read correctly the ESA is a member of the International Intellectual Property Alliance. Still, I can tell you from personal experience this isn't going to have much of an affect on pirating. Like most supranational organizations, simply adding a country's name to a list of "offenders" does not stop the offense from happening.
