so instead of getting drug dealers rapists and murders off the street they got him? Good I wouldn't want him skulking around my neighborhood.

Fun fact if he had actually raped a child under 14 he would have faced not more than 10 years in mass at least but if he hadn't had a plea bargain he would face faced up to 15 years...

Does he have to register himself as a sex offender???
The ANN article said that his defense wants the court to "make clear that he will not be registered as a sex offender".

How much do you wanna bet there's gonna be at least one person who shuffles through their manga collection and/or destroys some of it after reading this thread?
On a completely unrelated topic...
My friend wants to know how do you completely destroy all the data on a hard drive?
With a big ass magnet.
And/or a blowtorch.

thats a little bit easier.

That's so unconstitutional, it's sickening. Child porn hurts children. Drawings do not, unless you give them to children. Which this guy didn't. The law is so open ended now, you could outlaw Romeo and Juliet because they were underage.

Wasn't there already a few threads on this?

I don't see why he should be sentenced for this. No, I don't support child pornography and yes, this guy is disgusting, but:
Andy Chalk said:
...as Charles Brownstein of the Comic Book Legal Defense Fund noted, "The drawings are not obscene and are not tantamount to pornography. They are lines on paper."
It's a victimless crime, right? As long as he doesn't go around feeling up little boys and girls in the lockerroom, I don't see any reason to get the cops involved.

As much as he is a disgusting pervert, its his stuff so he can do whatever he wants with it. Its just a manga, not some super dildo or death weapon. Why are they getting so pressed om lines on paper?
This. Also, you can sentence a man that... for example, STOLE something for 15 years and $250,000 but not a pervert.

As disgusting and wierd as it all is..

.."possession of obscene visual representations of the sexual abuse of children"..Is that actually illegal?

It sounds hilariously Specific.

I was kinda on the fence about this, but I've finally come to a conclusion.
Criminal charges should not be filed, as there is no victim involved.
However, the items should be confiscated and he should be given psychiatric help. Hentai is porn, in this case porn of children. If that's what he is sexually aroused by (this being the purpose of porn) then he is in some part a paedophile. This doesn't mean he'll go out and molest children, but it wouldn't hurt to take preventative measures just in case.
Heck, if we did this with the easy to catch hentai importers, it might even give some insight into how to help fully blown paedophiles instead of scaring them into hiding.
Yeah and you know what else we should do? Lets grab all the people who fap to hentai, because that shit is weird. Also lets grab all the scat and gore people and the furries too. And the homos and the BDSM and the fat fetishists. Anyone who buys a dildo will be immediately arrested and playboy will be a felony. Also, lets kill us some Minorities because they're obviously a drain on society. Hell lets grab everyone who has a fetish or is of a different color and just throw them in a big flaming ditch!

You start doing that shit how long until the moral police come for you? How long till your fetish for sailor suits or whatever becomes a social deviancy worthy of psychological evaluation? How about you stop trying to beat people over the head with your morality? Unless you can show a DAMN good link between this and actual child molestation then you're talking out your ass. The difference between owning loli and molesting a child is the difference between shooting someone with a paint ball gun and unloading a minigun into a group of nuns.

Nah, I don't have any of that type of porn, child and bestiality? That's sick, but, seriously, it's just pictures, there are thousands of these things on the internet, I can't believe they destroyed someone's life for that.
ARREST THE INTERNET.

Seriously, this is ridiculous; it's art, not real.
I would find it hard to call that "art".
Well, excuse me, princess, I didn't realise you were the guy who makes laws.

Technically he wasn't charged for possession but for transporting the obscene material using "interstate commerce"

Simple possession of obscene material cannot be criminalized under the "right to privacy" of the 4th amendment of the U.S constitution.
So anyone is free to own obscene material in private, they're just not allowed to use "interstate commerce" to acquire said material.

It's kinda confusing; basically the law is saying that "you can have it" and "you can't have it" at the same time.

To anyone who says that there is no way this can be considered art, I'll direct you here.

http://nymag.com/daily/entertainment/2008/05/takashi_murakami_watches_from.html

Apparently it's art worth 15 million dollars.

Not actually my concern with this issue, really, it's more of the mentioned-before fact that it's not actually child porn. My comment was more me being a spiteful bastard than anything, though I think the "we don't deem it art so we arrest you" thing is, to momentarily borrow British slang, utter bollocks.

Of course, I've seen you repeatedly in these kind of threads, so this should be getting into...flamey territory.

Oh, and this guy said something relevant:

This is rediculous. Its illegal now to have strange porn? And not just any porn, porn of things that dont actually exist? This isn't a real crime; this is just some demonstration of how orwellian and unprivate society is getting. [sarcastically dons tinfoil hat before being flamed.]
