Pardon me if I don't see the distinction.

Both situations involve printed images of a young person, unquestionably below the "legal age" in question. Both are involved in sexual activity that is considered "illegal" in this context.

I cannot see how one is classified as "a work of art" and immune from scrutiny and the other isn't. Is it:
1) The age?
2) The price?
3) The skill involved in creating the image?
4) The country of origin?
5) The medium on which the picture is delivered?

In any case, I doubt if classifying it as art would have saved this guy. When people believe they are on a moral high ground and have too much free time, they will use all their energy, money and time to stroke their ego.

I wonder if the parcel inspector is happy with what he has done to a young man whose only crime was ignorance of postal regulations. If the parcel was, say, unmarked medicinal tablets, would the inspector have raised drug trafficking charges?

Well, I hate to think this is how our government handles differences in sexual preference. I personally have over 10,000 hentai/ecchi pictures, at least 1/3 to 1/2 of which is lolicon related.

That said, my entire REAL porn collection is all of rather well-endowed women clearly over the age of consent. Just having some manga of something out of the socially accepted norm shouldn't land you in the slammer.

As sick as child pornography is, I don't think comic books should be enough to send you to prison. That's a little... off. Especially considering the guy had no prior criminal record whatsoever.

I can't say I much care. Fuck, that stuff is disgusting. Not that I want to support censorship of any kind, but really, I can't believe people get hard over that stuff.

EDIT: I however, think that his arrest is ridiculous, at worst, the stuff should have been confiscated.

I did a brief study for a essay in the subject of taboo, and went into Lolicon (the specific sub-genre of Hentai in discussion) and if it has any links to real child porn (I like being controversial).

A conclusion I came to is, the only link between the two is the basic attraction towards taboo. A person who is into lolicon might also be into child porn but it's far more likely they are into the specific taboo of lolicon have no desire or interest in real child abuse (mainly because for the most part the content is completely different i.e Fantasy=/=Reality). It's basically the same idea of a person who is drawn to violent Games might be a serial killer, we know they exist but we know they are far too few to take ridiculous actions against. It's all dependant on an individuals state of mind. The more unstable the more likely this material may transfer to a real world context for the viewer.

Put simply, put someone with sociopathic tendencies in contact with a source material depicting violence/sexual deviancy could result in certain urges and desires to act on these sources in a real world context.

This is by no means a valid reason for courts to be involved. An investigation might be acceptable, but sentencing and a mandatory psychiatric therapy course is far too harsh for possession (or posting) of material that harms no one. This act on behalf of the courts is far worse then the content in question as it makes a harmless person/pervert similar to a sick fiend who actually does prey on real children.

EDIT: The sentence time itself is bullshit, as I've heard of real Sick deviants getting less then a year for actual sexual abuse towards a child. There is even one case where a person got 3 months for rape... 3 fucking months, and this minor perv got 6 for looking a some other pervs doodles. Justice my hairy ass.

I foresee a horrible future...

Seeing from the comments on this thread, he should have pleaded not guilty. What really pisses me off is that he needs 3 years of psychological treatment? What a joke, he's a harmless person with a few pictures.

The mind set of some people never ceases to amaze me. I don't know about the rest of the world but I was bought up to believe that there is a distinct difference between thinking/imagining something, and actually doing so. Hell if the thought police were about after some pissed me off I'd not only be in jail but also in a psych ward!

As for the poor sod and the hentai etc the punishment in my opinion does not fit the crime, he read some material, and your view on the material is irrelevant he didnt act on it. I know of many headlines of criminals beating up, mugging and/or killing etc and they have gotten less severe punishments - and that in my opinion is the real crime here not some chap getting his jollies off to something that doesnt exist.

There was nothing in the original post about him getting aroused over the images it was more to do with him importing & actually owning the comics in question, not from any gratification he got from them!
