I feel somewhat obligated to point out that most hentai---and most regular Japanese porn, for that matter---would be seen as a depiction of rape by many Westerners, whether it's labelled as such or not, because the women appear to be less eager than in non-Japanese porn. No, nothing should ever be banned for such reasons. Also, no it doesn't mean they're in really bad shape. I can't really explain it but I don't think that one can be used to justify the other. Rape is quite a bit more personal than mowing down 200 generic baddies.
It's the same reason that when you watch a martial arts move you don't say you were watching two people fight, you were watching two people act, while when you watch pornography, you feel that you're actually watching sex, and that what they're doing isn't exactly 'acting'.
