for those of you who are complaining people are switching sides, heres the thing: most people take the winning side no matter what, say you're watching a hockey game and the score is 8-0 (****in sharks) anyway you'd probably root for the team up by 8 rather than the team who probably could have won the series there if they weren't idiots...

point is you take the winning side, hackers fighting for your right to homebrew your PS3 as long as you don't go on PSN to Sony trying to get PSN back up and secure as much of your stuff as possible.

Exactly, all major networks should be worried about this. Steam and Live shouldn't be watching idly and laughing as they have a multimillion dollar network behind them.

The blame goes for both. Sony for not having better security and for having it take a week to tell us about the leak. The hackers for cracking the system and stealing all the data.

There are three types of hackers Black Hats, White Hats and Grey Hats. You can probably guess which is which from the colors and this is definitely the work of Black hats if they start to sell all the data. Grey hats if they return all stolen data to Sony. White Hats if we find out that Sony hired the hackers to try and take down the system.

Even the vaguest knowledge of criminal law (and given that I spent a decade working as a criminal lawyer, my knowledge of criminal proceedings in western nations isn't exactly vague) would inform you that even if Geohotz posted the code with a sign saying 'this will enable you to hack Sony's systems and steal the PSN private info', he still wouldn't be criminally liable for this case. Civilly liable, yes, but that's a moot point given that he is already getting sued for more than he could possibly pay. As for his civil liability in this actual case, well nothing has arisen thus far that would give any risk of liability, and there's no point even speculating on civil liability unless something arises that would prove causation to a civil standard.

You mind explaining how a hack to run homebrew code on your PS3 enabled the entire security of the PSN to be compromised? Sony's horrendous security is at fault here, not hackers playing homebrew code.
The PSN was obviously prepared for stuff like this to happen before hence no massive issues like this yet.

It wasn't prepared to deal with hackers potentially having the end all be all code that jailbreaks the PS3.

Yes. they do. It's a computer, people have a right to look into how their computers work at the code level and talk about it. If they want so much control over people's property, then they can charge less for it or lease it for 10 bucks a month.

Just because people make viruses for PCs doesn't mean software engineers should be thrown in prison for figuring out and sharing how the window OS works, and you don't see car companies dragging car enthusiasts into court for cracking their car computer to tweak performance.

So yea, Sony isn't special and they're no different than any other hardware manufacturer. Deal with that. Damn kids are being brainwashed into defending some corporate bully who can't even encrypt their customer data. Not even banks let hackers get away with the entire database and they're hacked all the time.

Having complete control over your own property is very much essential liberty. Even sharing information without punishment is essential liberty and the only people liable are those that misuse the information themselves. That's why it's perfectly legal to sell "The Anarchist's Cookbook" which tells people how to make bombs. Having knowledge isn't a crime, but thomgs people do with it can be.
