How do you make a mod for a game for which you do not work for the comapny then threaten legal action?


You can't threaten legal action for work done without the original copywriter holders approval, so you just whined "Hey that's my fan boy stolen code, if you use it or anything like it I'll sue, since i am already using it without permission."

This is why the modern gaming world fails...

And on the subject of copyright laws, would I be correct in assuming that some of these authors are some of the same people who usually spit on such copyright laws? Funny how the tables do turn. I call hypocrisy on this one!!

Here's the bottom line; this guy took a bunch of modders work, used them without their permission, and gave them little credit. Most of the people who made these mods were not happy with this, and wanted the mod taken down. I think they are perfectly justified in doing this.

SO BLOODY WHAT.... he's done the same as what every other modder does and no one has a right to tell him to stop... so they should all just bite the bullet, accept that 'their' work, ISN'T 'their work'.. and shut the hell up.

As soon as they made it they accepted that they didn't have a right a say squat... bleating about it now just makes them all sound like sour little children.

But... he's not making money off of it or anything. Why is updated credits not enough for you? Do you release them off your own sites? Probably not. Do you get money from the traffic when people download your mods? Probably not.

Yeah, I'm with the creator of the compilation on this one. I've been with the Morrowind and Oblivion modding community for a long time. A lot of these authors are indeed egotistical douchebags, and this move sounds just like them.

I can understand their want to be properly credited, and maybe the compilation author could have asked for permission, but I think he's made it rather clear that it's just a compilation of other people's work to improve the game. These modders just destroyed the chance to have their mod distributed to more than 1000 or so users.

Whatever, I got the compilation before this whole hiatus came to be. And yes, I'm going to use it. And yes I'm going to say "Fuck you!" every time I boot the game.

I find it hard to side with the original modders here though they do have a legit point, given that while it wasn't for profit and they were credited its still use of something that is theirs without their permission. I mean, I get that. Plus the guy who compiled the mod pack does get the most credit even if he did no modding. Your own personal contribution does kind of get buried in the crowd as it were. Still, people mix and match mods all the time personally, and for new users this can be extremely helpful. It's the old, "People do it anyway" claim, I know, but I think it holds some weight here since that's sort of the point of mods. Mods, for simplicity sake, enchance gameplay, so why not make a package that really enhances gameplay? I really don't get the legal action bit as, as best as I can interpret it, its the redistribution of something that's already free. Now, if he tried to profit off of it, sue his pants off. Otherwise I really don't see how lawsuits are even a legit recourse.

Don't the modders have to patent or make get a copyrights approval before being able to take legal action regarding plagiarism.

I'm indifferent to both parties. On one hand, the collaboration is nice and all. But on the other one, he didn't ask permission.
I still think that it is silly of the modders to not want to come up with a compromise.

Okay, looking at this, it made me think about what may actually be in the EULA for the World Editor that Modder's use. I know that somebody else already quote the appropriate section of the agreement, but I think I will again for my own points.

1. RESTRICTIONS ON USE
The Editor and any other software that is available for download from this Site is and shall remain the copyrighted property of Bethesda Softworks and/or its designee(s) and You shall take no action inconsistent with such title or ownership. You may not cause or permit the sale or other commercial distribution or commercial exploitation (e.g., by renting, licensing, sublicensing, leasing, disseminating, uploading, downloading, transmitting, whether on a pay-per-play basis or otherwise) of any New Materials without the express prior written consent of an authorized representative of Bethesda Softworks. This includes distributing New Materials as part of any compilation You and/or other Product users may create. You shall not create any New Materials that infringe upon the rights of others, or that are libelous, defamatory, harassing, or threatening, and You shall comply with all applicable laws in connection with the New Materials. You are only permitted to distribute the New Materials, without charge (i.e., on a strictly non-commercial basis), to other authorized users who have purchased the Product, solely for use with such users' own authorized copies of such Product and in accordance with and subject to the terms and conditions of this Agreement and all applicable laws. Now, as I read this... this does NOT give Bethesda ownership, but rather grants Bethesda (and ONLY Bethesda) the right to do with these mods as they see fit as part of being able to use their product. A game mod, like any other creative work, is in effect copyrighted as soon as it is created, as asserted in the "Berne Convention for the Protection of Literary and Artistic Works".

Additionally, there is the sentence stating: You shall not create any New Materials that infringe upon the rights of others, or that are libelous, defamatory, harassing, or threatening, and You shall comply with all applicable laws in connection with the New Materials. THIS is something that is directly at the heart of this issue, as the author of this mod DID infringe upon the rights of the authors.

There is nothing here that states that Bethesda owns anything anybody else does. They just have rights to use anything they want from the Mod community. This does NOT grant anybody else to do so.

Yeah, apparently mod creators should get praised and loved for their effort in improving Bethesda's work, but this guy should be threatened and trashed for his effort in improving the mod creator's work. (using the word improving loosely since it obviously doesn't always apply on a case by case basis)

Seems like both sides are at fault. The person who put it all together didn't go through the necessary channels and contact the individual modders to alert them about his project which may have had the overall impression it was all his work. The individual modders seemed to have overreacted to the whole situation and refused some sort of compromise; however with the internet being what it is, if anything is up for D/L for a second it can be distributed everywhere so ultimately the community wins but the creators lose.

You know, I've downloaded plenty of mod compilations, and I really like them. Especially in a case like this, they bring together the best mods for a game and documentation on how to make them work together properly. Anyone who's ever downloaded more than one mod for a game knows how much of a nightmare compatibility issues can be.
As long as Tyler credited all of the original authors (which it seems he did) and didn't try to make a profit off the mod pack (which, as far as I can tell, he didn't), I don't really see a problem here. Yes, the original authors worked hard on these mods and deserve credit. However, they've been given credit, and the idea of fanmade mods is that they be freely distributed throughout the community. As far as I'm concerned, the people fighting Tyler are getting pissy that they're not getting recognition that they wouldn't have gotten anyway. Seriously, how many of us have taken the time to email the creators of every mod we've ever used to thank them for their hard work?
